AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -2 TO H.B. COVERING A
PARCEL OF LAND COMMONLY KNOWN AS 2101 -2105 EAST EVANS AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
The zoning restrictions covering the following described property be changed from B -2,
Subregional Business District, to H.B., Historic Business Zone District, and upon passage of this
ordinance, zoning restrictions affecting H.B., Historic Business Zone District shall apply to said
property:
LOTS 41 THROUGH 44, BLOCK 37, LAKE MINNEQUA ADDITION
SUBDIVISION,
and more commonly known as:
2101 -2105 EAST EVANS AVENUE.
SECTION 2
With the recommendation of the Planning and Zoning Commission, this zoning
ordinance is approved with the following conditions:
1. Applicant shall be required to provide 1.5 off - street parking spaces for each
residential unit and remove the existing angle parking on Evans directly adjacent
to the building.
2. Applicant shall be required to plant street trees in the public right -of -ways on
Indiana Avenue and Evans Avenue and the off - street parking lot, in lieu of complying
with all of the provisions of Section 17 -4 -7 Landscape Performance Standard.
The City Planning and Zoning Commission is hereby authorized and directed to initiate
proceeding to rezone the above - described property to a B -2, Subregional Business Zone
District, if the property owners or heirs, successors or assigns fail to meet these conditions
within six (6) months of passage of this ordinance.
SECTION 3
This ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council approve a request to rezone the property for the purpose of developing
apartments that meets the standards of the H.B. Historic Business Zone District?
RECOMMENDATION
The Planning and Zoning Commission voted 7 -0 to recommended approval of the rezoning
with the following conditions:
1. Applicant shall be required to provide 1.5 off - street parking spaces for each
residential unit and remove the existing angle parking on Evans directly adjacent to
the building.
2. Applicant shall be required to plant street trees in the public right -of -ways on
Indiana Avenue and Evans Avenue and the off - street parking lot, in lieu of
complying with all of the provisions of Sec. 17 -4 -7 Landscape Performance
Standard.
BACKGROUND
The applicant has agreed to propose rezoning of their property from a Subregional Business
Zone District (B -2) to a Historic Business Zone District (H.B.) in order to convert the
existing building from a commercial use to apartments. The H.B. Zone District allows
apartments as a "use by right ", while retaining the character of the existing building within
the Bessemer Business Area. The building has the architectural style and aesthetic quality
of the corner commercial businesses in the Bessemer neighborhood. The If. B. Zone
District also allows some commercial uses to be retained within the building. In a H.B.
Zone District the Architectural Review Board must approve and issue a written certificate
of compliance prior to any alteration or modification of the exterior of the building. The

property is located at the southwest corner of Indiana and Evans Avenues and was
purchased by the applicant in August, 2000. The applicant would like to convert the
current three commercial units into apartments. The square footage of the portion of the
property that does not include the building would allow up to 8 off - street parking spaces on
the property. Based on the parking requirements, the applicant could have up to five
apartments, unless they secure a variance for parking. They are requesting a change in
zoning to allow a multi - family residence prior to completing the proposed conversion of
the building.
