AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM S -1 TO B -3 AND 1 -2
COVERING A PARCEL OF LAND COMMONLY KNOWN AS SOUTH OF SANTA FE
DRIVE AND WEST OF NORTHERN AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
The zoning restrictions covering the following described property be changed from S -1,
Governmental Use District, to B -3, Highway and Arterial Business District, and 1 -2, Light
Industrial District, and upon passage of this ordinance, zoning restrictions affecting B -3,
Highway and Arterial Business District and 1 -2, Light Industrial District, shall apply to said
property:
S -1 to B -3
Parcel Number 14 060 02 002: Lots 9 through 16, Block 89, Riverside Park Subdivision.
S -1 to 1 -2
Parcel Numbers 14 060 02 003 and 14 060 02 005: Lots 4 through 14, Block 99,
Riverside Park Subdivision
and more commonly known as:
South of Santa Fe Drive and West of Northern Avenue.
SECTION 2
This ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council approve a request to rezone a portion of the 10.76 -acre parcel that is
currently zoned S -1 to a Highway and Arterial Business Zone District (B -3) and a Light
Industrial District (I -2) so the property can be developed to the standards of these Zone
Districts?
RECOMMENDATION
The Planning and Zoning Commission voted 6 -1 to recommended approval of the
rezoning.
BACKGROUND
The applicant has a 10.76 -acre parcel located south of Santa Fe Drive and southwest of
Northern Avenue that is currently zoned B -4, S -1, and I -3. wishes to rezone that portion of
his property which is currently zoned S -1 Governmental Use which does not allow private
development. This property is adjacent to a parcel that contained a privately operated
swimming pool. The S -1 zoning area shown on the City zoning map was probably
associated with the swimming operation, but erroneously overlapped onto the applicant's
property. The rezoning is being submitted to clear up the S -1 zoning and to rezone the
property for uses that are compatible with the commercial character along Santa Fe Drive
and the Industrial character along Northern Avenue. A platted public right -of -way extends
from Santa Fe Drive onto the property and provides access to the lots within the proposed
B -3 and I -2 zone districts.

PLANNING AND ZONING COMMISSION MEETING MINUTES (NOVEMBER 14
2001) REGULAR MEETING
Mr. Hobson informed the Commission of the history of a previous hearing in July, 2001
and the applicants needing to return before the Commission with a land survey showing
an existing public right of way and a site plan showing the land boundaries. Anna
Concialdi, 3379 Siloam Rd. Beulah, Colorado, and Annamarie Colalancia, 928 Spruce
Street, appeared before the Commission representing the Concialdi Family Trust. They
stated they wish to change zone to sell this property and needed the change to make the
property versatile. Mr. Hobson pointed out on the map this property divided into
three sections. The upper area by Santa Fe Drive is to remain as a B -4 District, the
middle area be changed from S -1 to a B -3 District, and the lower area which includes the
1 -3 District and S -1 District be rezoned to I -2 District. The applicants agreed to amend
their application to request B -4, B -3, and I -2 zones as presented. Mrs. Green stated that
after the survey was done and reviewed by staff the dedicated right -of -way adjoining the
property appeared. No one else appeared to be heard. Chairman Soldan made the
staff report a part of the record and closed the hearing.

2001) SPECIAL MEETING
Mr. Lytle, seconded by Mr. Mabie moved to recommend approval subject to the
conditions that were presented by the staff today as opposed to the conditions that were in
the staff report. Mr. Lopez amended Mr. Lytle's motion stating that the property be
rezoned business and to illuminate the industrial zones as recommended by staff. A
discussion followed with Mrs. Green stating that until after the survey was done, it was
not known that this was not a single parcel of land and, with the help of an overlay of the
zone map, the survey showed that the land was subdivided into different pieces of
property. Mrs. Green stated that after the survey was done and reviewed by staff the
dedicated right -of -way adjoining the property appeared. She added that multiple zones
are now possible and recommended by staff to suit the needs of the possible buyers. Mrs.
Green stated the multiple rezoning is needed to conform with the rest of the surrounding
properties and allows the property owners flexibility with development of this property.
With no further discussion, Mr. Thomas seconded the amended motion to rezone the
entire Concialdi property as presented before the Commission as B -4. Motion was
defeated 6 -1 with Mr. Lopez voting yes. Chairman Soldan then went back to the original
motion, and the motion carried 6 -1 with Mr. Lopez dissenting.
