HomeMy WebLinkAbout06766ORDINANCE NO. 6766 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -2 TO 0 -1 COVERING A PARCEL OF LAND COMMONLY KNOWN AS 1201 PASEO DEL NORTE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 _ The zoning restrictions covering the following described property be changed from R -2, Single - Family Residential District, to 0-1, Neighborhood Office District, and upon passage of this ordinance, zoning restrictions affecting 0-1, Neighborhood Office District shall apply to said property: LOTS 1 -7, BLOCK 1, RANCHO DEL SOL 7 FILING SUBDIVISION, and more commonly known as: 1201 PASEO DEL NORTE. SECTION 2 With the recommendations of the Planning and Zoning Commission, this zoning ordinance is approved with the following condition: The applicant shall be required to provide the minimum five off - street parking spaces within 300' of Lot 1. The City Attorney must approve a continual lease agreement of these parking spaces. The City Planning and Zoning Commission is hereby authorized and directed to initiate proceedings to rezone the above - described property to a R -2, Single - Family Residential District, if the property owners or heirs, successors or assigns fail to meet the condition within six (6) months of passage of this ordinance. RECOMMENDATION The Planning and Zoning Commission voted 7 -0 to recommended approval of the rezoning with the following condition: The applicant shall be required to provide the minimum five off - street parking spaces within 300' of Lot 1. The City Attorney must approve a continual lease agreement of these parking spaces. BACKGROUND The applicant is proposing to have the property rezoned from a Single - Family Residential District (R -2 ) to a Neighborhood Office District (O -1) in order to permit the development of offices. The property includes seven lots along the east side of Pasco del Norte that is bordered on the south by Fortino Boulevard. A mobile home park borders the east side of the property. Inspectors required six foot wide sidewalks (for commercial use) be poured around the perimeter of 1201 Pasco del Norte. Lots 3 -7 also face 0-1 zoned lots and the City has made requirements for the intersection at Lot 7 to accommodate 0-1 usage. FINANCIAL IMPACT None Z -01 -28 PLANNING AND ZONING COMMISSION MEETING MINUTES (NOVEMBER 14 2001) REGULAR MEETING Cyndilee Bennett, 1201 Pasco Del Norte, appeared before Commission representing her application. She is before the Commission with plans to build offices each with the required five off - street parking spaces, and the landscaping requirement. She added the required six foot curbing was already in place before she inherited this property. No one else appeared to be heard. Chairman Soldan made the staff report a part of the record and closed the hearing. PLANNING AND ZONING COMMISSION MEETING MINUTES (NOVEMBER 14 2001) SPECIAL MEETING Mr. Lytle, seconded by Mrs. Depatie, moved to recommend approval subject to the staff conditions concerning parking being satisfied. Motion carried 7 -0.
