SECTION 2. The acceptance of such dedicated streets, rights -of -way, utility and drainage easements, public sites, parks and open spaces by the City does not obligate the City to maintain or repair same until such streets, rights -of -way, utility and drainage easements, public sites, parks and and open spaces have been constructed and installed in compliance and in accordance with the requirements and provisions of Chapter 4, Title XII of the 1971 Code of Ordinances, as amended and any agreement entered into pursuant thereto. SECTION 3. Neither the adoption of this ordinance and the requirements imposed hereby shall create any duty or obligation of any person, firm, corporation or other entity with regard to the enforce- ment or nonenforcement of this ordinance or the City's Subdivision Ordinances and regulations. No person, firm, corporation or other entity shall have any private right of action, claim or demand against the City or its officers, employees or agents, for any injury, damage or liability arising out of or in any way connected with the adoption, enforcement, or nonenforcement of this ordinance or the Subdivision Ordinance and Regulations of the City, or the engineering, surveying, drainage improvement or other work or improvements required thereby. Nothing in this ordinance or in the City's subdivision ordinances and regulations shall create or be construed to create any claim, demand or liability against the City or its officers, employees or agents, or to waive any of the immunities, limitations on liability, or other provisions of the Colorado Governmental Immunity Act, Section 24 -10 -101, et seq. Colorado Revised Statutes, or to waive any immunities or limitations on liability otherwise available to the City or its officers, employees or agents. SECTION 4. This ordinance shall be approved upon final passage but shall not become effective until (a) all information, documents, drawings, profiles, and plat required by Chapter 4 of Title XII of the 1971 Code of Ordinances meeting and complying with the subdivision require- ments of the City have been filed with and approved by the Director of Public Works, and (b) the final subdivision plat is recorded in the office of the Pueblo County Clerk and Recorder. If any such filings and approvals have been deferred pursuant to Section 12 -4 -5 (B) (2) of the 1971 Code of Ordinances, and are not for any reason filed and approved within one (1) year after final passage of this Ordinance, or within any extended period granted by Resolution of the City Council, this Ordinance shall automatically be rescinded and repealed thirty (30) days after written notice of such rescission and repeal is given to the Subdivider. The developers will construct Lake Avenue and associated infrastructure. Current Land Use According To Comprehensive Plan The 1980 Pueblo Regional Comprehensive Development Plan identifies this area for Light Industrial land uses. The soon to be adopted 2001 Plan identifies this area as Commercial and Office uses C. Field Observations Of Site The site is vacant land adjacent to existing commercial development to the north. Interstate 25 is in close proximity to this site. D. Neighborhood Compatibility Issues The proposed development should be compatible to the area. TRANSPORTATION: A. Department of Transportation Staff Review The roadway plat should show the appropriate number of public intersection spaces no further than 1320 feet apart. 2. The Subdivision Plat should reflect "No Vehicular Access" along the Lake Avenue frontage other than those points where public roadways intersect. S -01 -14 The right -of -way at the west most terminus must be of sufficient size to accommodate two thru lanes each direction, two westbound to southbound left turn lanes, one westbound to northbound right turn lane, and one eastbound acceleration lane for the northbound to eastbound right turn movement. Islands will separate right turn lanes. The right -of -way must also encompass sidewalks and any other public facility. 4. The applicant should be aware that as a result of the I -25 study, the alignment of Lake Avenue and the existing frontage road could be modified to allow an interchange midway between Pueblo Blvd. and the future Purcell Blvd. interchange. The interchange locations are currently being reviewed by the City, CDOT, and a consultant. 5. A 125 foot right -of -way width will be required rather than 100 feet to account for traffic flow, turn lanes and a 8 foot tree strip in the road median. 6. Applicant will need to replat Lake Avenue Extension once the adjacent lots and roadways are determined. Applicant should include an addendum to address construction along lake Avenue extension UTILITIES: A. Department of Public Works Staff Review Sanitary Sewer: No comments received. CONCLUSION: Approval of the SouthPointe Trade Center, Filing # 1 request is contingent on addressing the Department of Transportation's concerns regarding the right -of -way along the proposed Lake Avenue extension. PLANNING AND ZONING COMMISSION MINUTES (SEPTEMBER 12 2001) SPECIAL MEETING Bob Leach, Horizon Communities, appeared before the Commission and stated he has been in several meetings with staff and CDOT concerning the five items listed in the Subdivision Review Committee memo of July 25, 2001 and has satisfied all the concerns. Mr. Leach furnished the Commission with a letter from Valerie Watkins, Colorado Department of Transportation, dated September 12, 2001 approving the proposed Lake Avenue alignment. Each of the staff answered questions from the Commission concerning each of the five items. No one else appeared to be heard. Chairman Soldan made the staff reports a part of the record and closed the hearing. In a previous letter dated July 25, 2001 , CDOT made comment on the proximity of the proposed alignment of Lake Avenue with the Interstate 25 right -of -way and that the alignment was not acceptable. A meeting was held at CDOT offices between Mr. Leach, Mr. 5trava, Jackie Hall and me. Apparently, the Lake Avenue Extension Exhibit provided to CDOT was not the most current; therefore CDOT'5 comments were not accurate.
