HomeMy WebLinkAbout06710Substituted Copy 7/23/01 ORDINANCE NO. 6710 AN ORDINANCE AMENDING SECTION 605 OF CHAPTER 1 OF TITLE XI OF THE PUEBLO MUNICIPAL CODE RELATING TO FORTUNE - TELLING AND PROVIDING PENALTIES THEREFOR WHEREAS, Section 11 -1 -605 of the Pueblo Municipal Code prohibits fortune - telling, and WHEREAS, the City Council hereby finds and determines that fortune - telling should be permitted if a license is issued therefor, and WHEREAS, the City Council hereby finds and determines that the issuance of licenses permitting fortune telling is not contrary to the public health, safety and welfare. NOW, THERFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate matter Being deleted; underscoring indicates new matter being added) SECTION 1 Section 605 of Chapter 1 of Title XI of the Pueblo Municipal Code is hereby amended to read as follows: Sec. 11 -1 -605. Fortune- telling[prohibited]. (a) It shall be unlawful and a Class 2 municipal offense for any person to solicit or receive any compensation, gratuity or reward for practicing fortune - telling, palmistry or clairvoyance without a valid license therefor issued by the City provided, however, that the provisions of this Section as it relates to clairvoyance shall not be applicable to bona fide participation in religious worship of any legally constituted religious body which has been exempted by the United States Treasury Department under the Internal Revenue Code from paying federal income tax. be submitted for licenses required by Section 9 -1 -6 an applicant for a fortune - telling license shall submit a complete statement of all convictions of the applicant for any felony or misdemeanor, except misdemeanor traffic offenses (c) annual license fee may be modified by Resolution adopted by the City Council SECTION 2 Any person who violates Section 11 -1 -605 of the Pueblo Municipal Code shall be punished as provided in Section 11 -1 -103 (c) of the Pueblo Municipal Code. SECTION 3 If any provision of this Ordinance shall be found to be invalid or unenforceable, such finding shall not affect the remaining provisions of this Ordinance, which shall remain in full force and effect. SECTION 4 This Ordinance shall become effective upon final adoption.
