HomeMy WebLinkAbout06706ORDINANCE NO. 6706 AN ORDINANCE AMENDING TITLES XII AND XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO SUBDIVISION, REZONING AND ANNEXATION FEES BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate material being deleted; underscoring indicates new material being added.) SECTION 1 Subsections (a) and (c) of Section 5, Chapter 6, Title XVII of the Pueblo Municipal Code are amended to read as follows: 17- 6 -5(a) Before any action is taken, the applicant requesting a change in the district regulations or district boundaries shall deposit with the Finance Department an application fee [of one hundred fifty dollars ($150.00)] as set by resolution of the City Council to cover the approximate costs of this procedure. (c) Before any action shall be taken, the applicant seeking an annexation shall deposit with the Finance Department an application fee [of one hundred fifty dollars ($150.00) for the first ten (10) acres plus fifty dollars ($50.00) for each additional ten (10) acres or part thereof] as set by resolution of the City Council to cover the approximate costs of this procedure. SECTION 2 Section 6, Chapter 6, Title XVII of the Pueblo Municipal Code is hereby amended to read as follows: [Upon payment of the required ordinance fee,] The City Council shall consider the application for amendment of the zoning map, which application shall have followed the procedure set forth in Sections 17 -6 -2 through 17 -6 -5 inclusive. Section 3. Section 8, Chapter 4, Title XII of the Pueblo Municipal Code is amended to read as follows: Before any action shall be taken, the applicant seeking approval of the plat shall deposit with the Finance Department an application fee [of seventy -five dollars ($75.00)] as set by resolution of the City Council After the Planning and Zoning Commission has made its recommendations and before the preparation and presentation of an ordinance to the City Council by the planning staff, an ordinance fee [of seventy -five dollars ($75.00)] as set by resolution of the City Council must also be deposited with the Finance Department to cover the approximate costs of this procedure. Section 4 This ordinance shall become effective on August 1, 2001. RECOMMENDATION The Ordinance as proposed be adopted. The Planning and Zoning Commission has reviewed and approved of the proposed method of adopting fees. BACKGROUND Fees for the referenced zoning matters are currently set by Ordinance. To update fees, it is necessary to amend the ordinance. The proposed Ordinance will also allow the fees to be set by resolution. Following adoption of this ordinance, a resolution adopting a revised fee schedule will be presented to the Council for consideration. FINANCIAL IMPACT This Ordinance has no financial impact to the City of Pueblo.
