AN ORDINANCE VACATING AN ALLEY LYING BETWEEN
WEST FIRST STREET AND VICTORIA AVENUE AND EAST
OF SOUTH GRAND AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
All of the alley lying between Lots 6, 7, and 21 feet of Lot 8, Block 43, Pueblo and west
21 feet of Lot 3 and all of Lots 4 and 5, Block 43, in that part of the present City of Pueblo which
was surveyed and platted by H.M. Fosdick, Civil Engineer, for the Probate Judge of said Pueblo
County, in March 1869.
is hereby vacated.
This ordinance shall become effective immediately upon final passage and approval.

The City is requesting a partial alley vacation in order to prow

C. Field Observations Of Site
This site was visited by Planning Staff on March 20, 2001. The subject alley appears
to be in use by the El Pueblo Museum only. There is access away from the alley for
Timmie Motors.
D. Neighborhood Compatibility Issues
The proposed partial alley vacation alone should not generate any compatibility
issues with the surrounding area businesses as long as adequate access is provided.

SPECIAL INFORMATION:
The following analysis is based on Section 12 -5 -1 of the Code of Ordinance for the City of
Pueblo. The following information is required of any person or public or private agency
desiring the vacation of a street, alley or public right of way.
1) The interest of the applicant and the interest of the person represented by the applicant, be
it legal, sales, development, operation or other interests.
The location of the proposed partial alley vacation is between West First Street and
Victoria Avenue and east of South Grand Avenue. The section of vacated alley is
necessary for the construction of the new El Pueblo Museum expansion. The City,
State, County, and Community have been working on this project since 1996. The
proposed expansion is scheduled to start construction in June 2001.
2) A general description of the area surrounding the proposed vacation which will be
thereby affected; such description including subjects of environmental effect, economic
effect and traffic effect.
The area surrounding the proposed alley vacation is in the center of the Central
Downtown Framework Plan. The El Pueblo Museum project is one of the last
components to be developed in the plan. The State of Colorado owns the properties
on both sides of the proposed vacation. The surrounding land uses in the area
consist of primary and secondary commercial, office, senior residential,

historic business district, and public /governmental. No environmental effect will be
caused by the proposed vacation. The proposed vacation would eliminate vehicular
access to and from Grand Avenue. The properties in the entire block are owned by
the City of Pueblo and the State of Colorado except for one private commercial
owner, Timmie Motors, located at 215 N. Victoria Avenue. The vacation of this
section of the alley and construction of the museum would limit access of the alley
for the private property owner, however the City has provided an access from
Union Avenue. The owner of 215 N. Victoria is currently in acquisition negotiations
with the City with the intention of a settlement by June of 2001.
3) A tentative plan showing the area affected by the proposed vacation, showing existing
and proposed structures, uses, and open spaces, facilities for parking and loading, and
arrangements for pedestrian an vehicular circulation.
This has been provided with the Alley Vacation submittal.
CONCLUSION:
The Subdivision Review Committee and Planning Staff feel that this partial alley vacation
request should be approved based on the application request and report from the Department
of Planning and Development regarding the El Pueblo Museum expansion plans.
PUBLIC HEARING MINUTES (APRIL 11, 2001, SPECIAL MEETING)
Bill Zwick, Senior Planner, appeared and informed the Commission that the City is
requesting a partial alley vacation between 1st Street and Victoria Avenue for the purpose of
the expansion of the El Pueblo Museum. The State will expand the existing museum
building and extend it to the old TREA building and will need this section of the alley to
make the total expansion. The expansion is State funded and there is a deadline of June 30 th .
He continued on to state the ingress and egress for the only other private property owner
( Timme Motors) will still be able to obtain access into the existing alley via Union Avenue to
load and unload. No one else appeared to be heard. Chairman Soldan made the staff report a
part of the record and closed the hearing.
COMMISSION DECISION (APRIL 11, 2001, REGULAR MEETING)
Mr. Mabie, seconded by Mrs. Depatie moved to recommend approval. Motion carried 5 -0.
