AN ORDINANCE EXTENDING THE TERM OF THE CURRENT
COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY
OF PUEBLO AND THE PUEBLO ASSOCIATION OF
GOVERNMENT EMPLOYEES AND FIXING COMPENSATION FOR
2002 FOR ALL CITY OF PUEBLO EMPLOYEES IN THAT
BARGAINING UNIT
WHEREAS, the City Council decision to extend the term of the current collective
bargaining agreement by and between the City of Pueblo and the Pueblo Association
of Government Employees was formalized by Resolution No. 9234 passed March 15,
2001; and
WHEREAS, said Resolution extended the term of said agreement upon the same
terms and conditions, except that wages beginning January 1, 2002 shall be as
provided in Article 15 of said agreement; and
WHEREAS, section 3 -17 of the City Charter requires that every Council act
fixing compensation shall be by ordinance; and
WHEREAS, Article 10 section 20 of the Constitution of Colorado (the "Tabor
amendment ") could be interpreted to require that compensation for each year of the
PAGE collective bargaining agreement be authorized by a separate ordinance;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO that:
Section 1. The monthly pay rate for all employees in each class in the PAGE
bargaining unit commencing January 1, 2002 and ending December 31, 2002 shall be
increased by 3.3% over the amount set by the ordinances for the preceding year, as
set forth in Article 15 Section 1 of the current collective bargaining agreement
between the City of Pueblo and the Pueblo Association of Government Employees.
Section 2. This ordinance shall become effective immediately upon final passage.

Should the City Council approve a 3.3% pay raise for employees in the PAGE
bargaining unit for 2002 by ordinance?
RECOMMENDATION:
Administration recommends passage of this ordinance.
BACKGROUND:
In December 1999, the Pueblo City Council and the Pueblo Association of
Government Employees signed a collective bargaining agreement with a one year
term beginning January 1, 2000 and ending December 31, 2000. That agreement
provided that the City Council could at its option extend the agreement for two
additional one year terms through 2001 and 2002, with a 3.3% wage increase each
year.
The City Council extended the term of said agreement through calendar year
2002 by passage of Resolution # 9234 on March 15, 2001.
Due to a potential conflict with certain provisions of the Tabor amendment to the
Colorado Constitution, City administration recommends that the City Council
decision to extend the agreement through calendar year 2002 and grant a 3.3% pay
increase to the general service employees be formalized through passage of a City
Ordinance in addition to the Resolution previously passed.
FINANCIAL IMPACT:
The compensation package will require an additional 3.3% above the level of
2001 expenditures for general services employee wages and pension contributions.
