HomeMy WebLinkAbout06644"AS AMENDED" ORDINANCE NO. 6644 AN ORDINANCE IMPOSING AN EMERGENCY TELEPHONE CHARGE FOR EMERGENCY TELEPHONE SERVICE AND CREATING THE EMERGENCY TELEPHONE CHARGE FUND WHEREAS, the City of Pueblo has implemented in conjunction with the telephone service provider for use of its citizens a telephone system utilizing the single three -digit number 9 -1 -1 for reporting police, fire, medical, or other emergency situations ( "emergency telephone service "); and WHEREAS, pursuant to section 29 -11 -101 et seq., C.R.S., the City Council of the City of Pueblo is authorized to impose an emergency telephone charge for such emergency telephone service ( "emergency telephone charge "). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 The City Council does hereby find and determine that (a) the immediate imposition of an emergency telephone charge for emergency telephone service is necessary and required to obtain funding to pay equipment costs, installation costs, and directly - related costs of the continued operation of an emergency telephone service including payment of the monthly recurring charges of service providers, and (b) the imposition of an emergency telephone charge and continued operation of an emergency telephone service will promote the public health, safety and welfare. SECTION 2 There is hereby imposed an emergency telephone charge in the amount of forty cents (40¢) per month per exchange access facility and wireless communication access in those portions of the City of Pueblo's jurisdiction for which emergency telephone service will be provided. SECTION 3 The emergency telephone charge established and imposed by this Ordinance shall be collected by the service providers from a service user with the first billing period of each service user on or following April 1, 2001. SECTION 4 The rate of emergency telephone charge established and imposed by this Ordinance shall be a continuing charge during calendar year 2001 and each calendar year thereafter unless the City Council by Resolution adopted no later than September 1 of any calendar year establishes a rate of charge which is less than the rate of charge established and authorized by this Ordinance. SECTION 5 Pursuant to Section 7 -21 of the Charter of the City of Pueblo, there is hereby created a Special Fund to be known as the "Emergency Telephone Charge Fund" to be held separate and apart from the general fund of the City of Pueblo. All funds collected from the emergency telephone charge imposed by this Ordinance shall be credited to the Emergency Telephone Charge Fund for payments pursuant to 29 -11- 104(2), C.R.S. Funds on deposit in the Emergency Telephone Charge Fund are hereby continuously appropriated for said payments and may be expended upon Resolution adopted by the City Council. SECTION 6 The officers of the City of Pueblo are authorized and directed to take all action necessary, appropriate or required to effectuate the provisions of this Ordinance. SECTION 7 If any provision of this Ordinance shall be determined to be invalid, inoperative or unenforceable, such determination shall not affect any other provision or provisions of this Ordinance or render same invalid, inoperative or unenforceable to any extent whatsoever. -2- SECTION 8 This Ordinance shall become effective upon final passage and approval. INTRODUCED: January 8, 2001 ATTEST: Ci lerk PASSED AND APPROVED: uanuary Cz , nW 1 -3- By Robert Schilling Councilperson 0 ,S JANUARY 8, 2001 AGENDA - CITY COUNCIL BACKGROUND MEMORANDUM - ORDINANCE IMPOSING AN EMERGENCY TELEPHONE CHARGE FOR EMERGENCY TELEPHONE SERVICE AND CREATING THE EMERGENCY TELEPHONE CHARGE FUND The Ordinance imposes an emergency telephone charge in the amount of 70¢ per month per exchange access facility and wireless communication access in those portions of the City of Pueblo's jurisdiction for which emergency telephone service will be provided as authorized by section 29 -11- 101 et seq., C.R.S. Based upon information furnished by Qwest to the Pueblo Police Department, there are approximately 70,000 exchange access facilities from customers' premises within the City to the telecommunication network to effect the transfer of information. The emergency telephone charge of 70¢ per month would generate monthly net revenue of approximately $48,000 which will be credited to a Special Fund, apart from the general fund of the City, for payments authorized by section 29 -11- 104(2), C.R.S. which includes payment for cost of equipment and installation, monthly recurring charges of service providers, and other costs, excluding personnel costs directly related to the continued operation of the emergency telephone service. According to Qwest representatives, they need 60 days to implement the collection of the emergency telephone charge after adoption of the Ordinance and notification to Qwest. Therefore, if the Ordinance is passed in January 2001, the charge would be implemented and collected for emergency telephone service with the first billing of each service user on or following April 1, 2001.
