AN ORDINANCE AMENDING CHAPTER 6 OF TITLE XVI
OF THE PUEBLO MUNICIPAL CODE RELATING TO SEWER
USER CHARGES
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicates
matter being deleted; underscoring indicates new matter being added.)
SECTION 1.
Section 16 -6 -2 of Chapter 6 of Title XVI of the Pueblo Municipal Code, as amended, is
hereby amended, by amending paragraph (1) of Subsection (a) thereof to read as follows:
Sec. 16 -6 -2. Rates and charges.
(a) Nonindustrial users. The wastewater charge for nonindustrial users shall be the
total of the monthly service charge and monthly sewer volume charge, computed as
follows:
(1) The monthly service charge portion of the wastewater charge shall be assessed
and charged based upon the water meter size of the water line or lines servicing the
property in accordance with the following table:

SECTION 2.
Section 16 -6 -2 of Chapter 6 of Title XVI of the Pueblo Municipal Code, as amended, is
hereby amended, by amending paragraph (1) of Subsection (c) thereof to read as follows:
Sec. 16 -6 -2. Rates and charges.
(c) Blende Sanitation District
(1) For wastewater delivered to the City's treatment plant from Blende Sanitation
District and derived exclusively from nonindustrial customers, the volume charge shall be
[eighty -two cents ($0.82)] eighty -five cents $( 0.851 per one thousand (1,000) gallons,
together with such monthly service charges as may be provided by agreement or
resolution of the City Council.
SECTION 3.
Section 16 -6 -2 of Chapter 6 of Title XVI of the Pueblo Municipal Code, as amended, is
hereby amended, by deleting paragraphs (2) and (3) of Subsection (e) thereof, to read as
follows:
Sec. 16 -6 -2. Rates and charges.
(e) Airport Collection System
(1) The wastewater charges for all users connected to the Airport Collection System
shall be as provided in Subsection (a) and (b) of the Section, subject to the provisions of
this Subsection (e).
(2) (Reserved ). [With respect only to those users connected to the Airport Collection
System prior to July 1, 1992, wastewater charges shall be phased in as provided in the
following table:

(3) (Reserved) [All users first connected to the Airport Collection System on or after
July 1, 1992, shall, immediately upon connection to the system, pay and be responsible
for the full amount of wastewater charges determined as provided by Subsections (a) and
(b) of the Section.]
(4) The wastewater charges set forth herein for users connected to the Airport
Collection System shall be in addition to, and not in lieu of, any and all other charges or
fees associated with or assessed to property owners or occupants of facilities located at
the Pueblo Memorial Airport or the Airport Industrial Park.
SECTION 4.
Section 16 -6 -4 of Chapter 6 of Title XVI of the Pueblo Municipal Code, as amended, is
hereby amended, by deleting Subsection (b) thereof:
Sec. 16 -6-4. Restricted use of wastewater charges.
(a) All revenues received by the City from the sewer charges shall be used
exclusively for the operation, maintenance, construction, replacement and expansion of
the wastewater treatment works and appurtenances, including sanitary sewers and
administrative and engineering costs related thereto; provided, however, that revenues in
excess of those necessary for operation and maintenance (including replacement) may be
pledged by formal action of the City Council as all or part of the City's share of grants
available from other governmental agencies or for the payment of principal and interest
upon bonds issued for the construction and expansion of wastewater treatment works,
collection and related facilities.
[(b) For the purpose of allocating revenues from wastewater charges between
operation and maintenance (including replacement) and capital costs (construction and
expansion of wastewater treatment works, collection and related facilities), the City
Council, based upon the findings of Black & Veatch 1987 Study on Wastewater Utility
Revenue Requirements, Costs of Service, and Rates for the City of Pueblo, Colorado,
hereby finds and determines that the user charge portion of the monthly volume charges
representing costs of operation and maintenance is sixty -one cents ($0.61) per one
thousand (1,000) gallons and that the user charge portion of the monthly service charges
representing costs of operation and 'maintenance is:

Based upon said report, the City Council also finds and determines that the user charge
portion of the excessive strength wastewater surcharge representing costs of operation
and maintenance is $0.0699 per pound for excessive BOD and $0.0557 per pound for
excessive suspended solids. The City Council futher finds and determines that the user
charge portion of the monthly volume charge for -Blende Sanitation Districe representing
costs of operation and maintenance is forty -three cents ($0.43) per one thousand (1,000)
gallons.]
SECTION 5.
It shall be unlawful and a municipal offense for any person to violate, disobey, neglect,
refuse or fail to comply with or resist the enforcement of any provision of this Ordinance
and upon conviction therefor said person shall be punished as provided in Section 16 -6 -11
of Chapter 6 of Title XVI of the Pueblo Municipal Code, as amended.
SECTION 6.
This Ordinance shall become effective immediately upon final passage and approval
provided that the rate charges made therein shall apply to all wastewater services provided
on or after February 1, 2001 which are billed commencing in March, 2001 by the Board of
Water Works or directly by the City.
