HomeMy WebLinkAbout06638Reception 1414308 12/03/2001 Substituted Copy As Amended ORDINANCE NO. 6638 AN ORDINANCE APPROVING WITH CONDITIONS THE LAREDO AT PARKSIDE SUBDIVISION SPECIAL AREA PLAN WHEREAS, the Laredo at Parkside Subdivision Special Area Plan was submitted to the Planning and Zoning Commission for approval pursuant to Section 17 -4 -29 of the Pueblo Municipal Code; and WHEREAS, the Planning and Zoning Commission after a public hearing found and determined the objectives and requirements of said Section 17 -4 -29 can and will be met, and WHEREAS, the Planning and Zoning Commission recommended Laredo at Parkside Special Area Plan be approved with conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. With the recommendations of the Planning and Zoning Commission, the Laredo at Parkside Special Area Plan is approved with the following conditions: 1. When a building permit is applied for, each Laredo at Parkside lot owner shall pay $108 per lot towards the purchase and installation of the traffic signal at the corner of Beulah/Mirror Streets and Pueblo Boulevard. 2. The Subdivider shall establish a homeowners' association and shall adopt and record, after approval by the City Attorney, private restrictive covenants for the homeowners' association to enforce and assist in improving and maintaining the Property. 3. When a home is built on each lot in the Special Area Plan, there shall be constructed a private driveway which extends at least thirty -six feet (36') from the back of the sidewalk before a certificate of occupancy for the home is issued. 4. The Subdivider shall prepare for the Special Area Plan a park development plan for review and approval by the City Subdivision Review Committee. The park plan shall include appropriate play areas for children with swing sets, picnic and barbecue areas and other park amenities the City's Subdivision Review Committee deems appropriate to serve the needs of the residents in the area. The park and its amenities shall be installed in accordance with a phased plan of park development as approved by the City Subdivision Review Committee. 5. The Subdivider shall provide the City Subdivision Review Committee and the Pueblo Regional Building Department with a list of the lots for which the restrictive covenants will prohibit installing basements. Such list shall be reviewed and approved by the City Subdivision Review Committee to include all lots deemed inappropriate for basements due to the high water table in the area surrounding the Special Area Plan. 6. OAENeal Circle shall be modified for safety reasons to comply with the requirements imposed by the City Department of Transportation and the City Subdivision Review Committee SECTION 2. This ordinance shall become effective upon final passage. .; ; 43 .
