HomeMy WebLinkAbout06596ORDINANCE NO. 6596 AN ORDINANCE DEDICATING A PERPETUAL EASEMENT IN GROSS FOR SANITARY SEWER PURPOSES WHEREAS, the City of Pueblo, a Municipal Corporation, is the owner of a parcel of real property located within the County of Pueblo and State of Colorado described as: North '/2 of Lot 20, All of Lots 21 thru 34, Block 15, La Veta Park Sub., County of Pueblo, Pueblo, Colorado, hereinafter referred to as the "Property "; and WHEREAS, the City Council finds and determines that a portion of the Property should be dedicated as a sanitary sewer easement for perpetual use; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1 The City Council hereby dedicates a perpetual easement in gross for the purpose of constructing, operating, maintaining, repairing and replacing publicly -owned sanitary sewer lines and facilities in, through, over, under and across the Property, said easement being particularly described as: The West twenty feet (20') of the North ' / 2 of Lot 20, and the West twenty feet (20') of Lots 21 thru 34, except that portion lying within Lowell Avenue right -of -way, Block 15, La Veta Park Subdivision, County of Pueblo, Pueblo, Colorado See attached EXHIBIT A SECTION 2 This City reserves the right to use and occupy the Property for any purpose not inconsistent with the easement dedicated herein, provided that no building or other permanent structure shall be erected upon the easement dedicated herein. INTRODUCED September 25 ' 2000 By Rich Golenda Councilperson APPROVED: President of the Council ATTEST: City Clerk Passed and Approved: October 10, 2000 -2- t.V ull ull lAgtalua Title: AN ORDINANCE DEDICATING A PERPETUAL EASEMENT IN GROSS FOR SANITARY SEWER PURPOSES Department: WASTEWATER DEPARTMENT ISSUE Agenda Item # Date: September 25, 2000 Should the City Council dedicate a perpetual easement for a sanitary sewer pipeline within property currently owned by the City, located between Lowell Avenue and Temple Ln., South of W. 28th Street. RECOMMENDATION Approval of the Ordinance. BACKGROUND A portion of the 3000 block on W. 28th Street was recently annexed into the City of Pueblo. Following the annexation, residents requested sanitary sewer service. A CDBG Grant has been approved for the installation of the sewer. In order to serve the lots, a twenty foot (20') easement within City property is required. This easement will protect the right -of -way for the sanitary sewer main in the event the City sells the property. FINANCIAL IMPACT This project will be funded by CDBG Grant.
