HomeMy WebLinkAbout06587ORDINANCE NO. 6587 AN ORDINANCE AUTHORIZING THE USE OF ELECTRONIC RECORDS AND ELECTRONIC SIGNATURES FOR CITY GOVERNMENTAL TRANSACTIONS, AUTHORIZING THE UTILIZATION OF THE COLORADO GOVERNMENT ELECTRONIC TRANSACTIONS ACT, AND DIRECTING THAT THE RULES AND REGULATIONS ADOPTED BY THE EXECUTIVE DIRECTOR OF THE COLORADO DEPARTMENT OF PERSONNEL BE FOLLOWED IN THE CITY'S USE OF ELECTRONIC RECORDS AND ELECTRONIC SIGNATURES WHEREAS, the City intends to adopt and implement the use of electronic records and electronic signatures; and WHEREAS, the Colorado Government Electronic Transactions Act ( "Act ") applies to electronic records and electronic signatures generated, stored, processed, communicated, or used for any governmental transaction, and WHEREAS, the Act authorizes local public entities to utilize provisions of the Act upon approval of the local public entity's governing body, and WHEREAS, the City Council hereby finds and determines that the utilization of the provisions of the Act by the City would promote the public health, welfare, convenience and safety. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City Council does hereby authorize the use of electronic records and electronic signatures generated, stored, processed, communicated or used for any City governmental transaction. SECTION 2. Except as otherwise provided in the Government Electronic Transactions Act, Article 71.1, Title 24, C.R.S. (the "Act ") and except where electronic transactions are expressly prohibited by the Charter, state or federal law, the City will utilize the provisions of the Act in the use of electronic records and electronic signatures generated, stored, processed, communicated or used for any City governmental transaction. SECTION 3. The rules, standards, procedures and policies for the use of electronic records and electronic signatures by public entities adopted and promulgated by the executive director of the department of personnel of the State of Colorado pursuant to section 24- 71.1- 110(1)(a), C.R.S. ( "State Rules and Regulations ") shall be followed in the City's use of electronic records and electronic signatures. SECTION 4. The Director of the Department of Information Services shall implement, supervise and be responsible for the implementation and supervision of the City's use of electronic records and electronic signatures in the manner authorized by this Ordinance. The Director of the Department of Information Services shall adopt rules, standards, procedures and policies with the approval of the City Manager and in conformity with the Act, the State Rules and Regulations, this Ordinance and the Charter, for the use of electronic records and signatures by the City, its employees, departments, agencies, boards, commissions and council. SECTION 5. Nothing in this Ordinance shall be deemed to alter any legal or Charter requirement that a contract or agreement be in writing, authorized and approved as provided in the Charter, nor shall anything contained in this Ordinance alter any Charter provision specifically requiring oaths, contracts, agreements, budgets, journals, 7 ordinances, resolutions or other documents to be in written or printed form. This Ordinance shall not apply to any record that serves as a unique and transferable token of rights and obligations including, without limitation, negotiable instruments and other instruments of title wherein possession of the instrument is deemed to confer title. SECTION 6. The City Council finds and determines that the written requisition and Director of Finance certification required by Section 7 -30 of the Charter means and includes electronic requisitions and certifications as well as requisitions and certifications in written or printed form. The City Council does further find and determine that the Director of Finance in prescribing the form of receipts, bills, vouchers, or claims to be used by all offices, departments and agencies of the City government as provided in Section 7 -19 of the Charter is authorized to prescribe electronic forms and electronic signatures in addition to, or in lieu of, written or printed forms and signatures.
