ORDINANCE NO. 6551
AN ORDINANCE VACATING THE FRONTAGE ROAD LYING SOUTH OF U.S. HIGHWAY 50
WEST AND WEST OF BALTIMORE AVENUE SUBJECT TO A CONDITION SUBSEQUENTLY
BEING MET
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:

A portion of the Frontage Road lying south of U.S. Highway No. 50,
west of Baltimore Avenue and north and adjacent to Lot 1, Block 1,
Baltimore Plaza, located within the E Y2 of Section 14, Township 20
South, Range 65 West being more particularly described as follows:
Beginning at the northwest corner of said Lot 1, Block 1, Baltimore
Plaza; thence N 00 0 00'00" E, along the west line of said subdivision, a
distance of 31.85 feet; thence S 78 0 11'46" E, parallel to the north line
of said Lot 1, a distance of 102.95 feet; thence along the arcof a non -
tangent curve to the right whose center bears S 30 0 18'57 "W, and
having a central angle of 40 °28'44 ", and a radius of 72.00 feet, and a
distance of 50.87 feet to a point on the north line of said Lot 1; thence
N 78 0 11'46" W, along said north line, a distance of 135.28 feet to the
point of beginning,
is hereby vacated, reserving, however, to the City of Pueblo and utility owners the right at all
times to repair, operate or replace existing utilities and sewer and water lines, and mains
together with the right of ingress and egress to accomplish same.
SECTION 2
The reservations set forth in Section 1 hereof shall automatically terminate upon
recording in the Pueblo County Clerk and Recorder's office a verified statement of the Director
of Public Works of the City of Pueblo certifying that all utilities and sewer and water lines and
mains existing in said vacated street have been removed or abandoned.
With the recommendations of the Planning and Zoning Commission, this vacation is
approved with the following conditions:
That the applicant landscape the 10 -foot strip of land immediately
south of the Highway right -of -way to the north edge of the bike and
pedestrian trail. Landscaping shall meet the requirements of the City
Landscape Ordinance.
SECTION 4
This ordinance shall be approved upon final passage but shall not become effective nor
shall this Ordinance or the Street Vacation Plat be recorded until the landscaping described in
Section 3 hereof is installed and approved by the Director of the Department of Zoning. The
recording of this Ordinance or Street Vacation Plat shall conclusively establish that the
landscaping has been so installed and approved.
