ORDINANCE NO. 6509
AN ORDINANCE VACATING A FRONTAGE ROAD AT THE NORTHWEST CORNER
OF U.S. HIGHWAY 50 WEST AND FORTINO BOULEVARD SUBJECT TO
CONDITIONS SUBSEQUENTLY BEING MET
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The North 1/2 of the Frontage Road lying adjacent to Lots 1 through 4, Block
5, Gateway Subdivision First Filing according to the recorded plat thereof,
filed for record June 26, 1979, in Book 1991 at Page 460 of the Pueblo County
records and adjacent to Lots 1 & 2, Block 1, Northridge No. 13 according to
recorded plat thereof, filed for record August 4, 1989 in Book 2456 at Page
26 of the Pueblo County Records and adjacent to Lots 1 & 2, Northridge No.
12 according to the recorded plat thereof, filed for record July 30, 1976 in
Book 1855 at Page 699 of the Pueblo County Record,
is hereby vacated, reserving, however, to the City of Pueblo and utlility owners the right
at all times to repair, operate or replace existing utilities and sewer and water lines, and
mains together with the right of ingress and egress to accomplish same.
SECTION 2.
The reservations set forth in Section 1 hereof shall automatically terminate upon
recording in the Pueblo County Clerk and Recorder's office a verified statement of the
Director of Public Works of the City of Pueblo certifying that all utilities and sewer and
water lines and mains existing in said vacated street have been removed or abondoned.
SECTION 3.
With the recommendations of the Planning and Zoning Commission, this vacation
is approved with the following conditions:

1. Ingress- Egress access easements for the benefit of Lots 2, 3 and 4, Block 5,
Gateway Subdivision, First Filing, to Fortino Boulevard are to be provided;
2. A proposed grading plan is to be submitted which shows how current drainage
along the Frontage Road will be handled in the future;
3. Deeds are to be provided to the City for any portions of the proposed vacation
upon which public improvements, such as curb and gutter, and sidewalks are
to be built.
SECTION 4.
This ordinance shall become effective immediately upon final passage and approval.
