HomeMy WebLinkAbout06458'i ORDINANCE NO. 6458 — AN ORDINANCE ESTABLISHING A ONE HUNDRED TWENTY DAY MORATORIUM ON LOCATING AND CONSTRUCTING ANTENNAS AND TOWERS WITHIN THE CITY OF PUEBLO WHEREAS, the Pueblo City Council desires to protect residential areas and other land uses from the potential adverse impacts of communication towers and antennas; and WHEREAS, the City Council strongly encourages the owners of such towers and antennas to locate same, to the extent possible, in areas where the adverse impact on the community is minimal; and WHEREAS, the City Council is in the process of establishing general guidelines and regulations for locating wireless and other communication towers and antennas including the consideration for adoption of a comprehensive ordinance concerning such towers and antennas; and WHEREAS, the pace of technology may result in a proliferation of towers in inappropriate locations unless a temporary moratorium is imposed while the City Council considers adoption of guidelines and regulations, including a comprehensive ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1 Neither the Department of Zoning nor the Zoning Board of Appeals shall, for a period of one hundred twenty days from the date of adoption of this Ordinance, approve, consider for approval or accept applications to site or construct a telephone, radio, television, microwave or other communication antenna or tower until and unless reasonable guidelines and requirements are adopted by the Pueblo City Council concerning the locating of such towers and antennas; provided, however, that this moratorium shall not apply to any tower, or the installation of any antenna, that is under seventy (70) feet in height and is either owned or operated by a federally - licensed amateur radio operator or is used exclusively as a receive only antenna. SECTION 2 The Council finds and declares that this Ordinance is necessary for the immediate preservation or protection of public health, property or safety, and it shall become effective immediately upon final passage and approval; provided, however, that it shall not be construed to apply to any tower or antenna for which zoning approval has been obtained and a building permit issued prior to the effective date of this Ordinance.
