HomeMy WebLinkAbout06440Fr ORDINANCE NO. 6440 AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XI OF THE PUEBLO MUNICIPAL CODE RELATING GENERALLY TO ANIMALS, ESTABLISHING A PILOT PROGRAM FOR NEUTERING ADOPTED ANIMALS AND MAKING AN APPROPRIATION THEREFOR BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate matter being deleted; underscoring indicates new matter being added.) SECTION 1. Council finds and determines that notwithstanding efforts by the City and by civic groups to promote the spaying and neutering of animals, the animal population within the City continues to climb; that excessive numbers of unwanted puppies and kittens are frequently abandoned or otherwise mistreated; that the City must euthanize large numbers of unwanted animals which could be prevented if more pet owners spayed or neutered their pets; and that additional measures are necessary and appropriate to further promote the spaying and neutering of animals in the community. SECTION 2. Chapter 4 of Title XI of the Pueblo Municipal Code, as amended, is hereby amended by the addition of a new section 11 -4 -16.5 thereto, to read as follows: Sec. 11 -4 -16.5. Pilot Proaram for Soavina of Adooted Animals. (a) On and after the effective date of this section, and for so long as there is an annual appropriation for the program established by this section and an unexpended balance remaining under said appropriation, the procedures set forth in this section shall apply with respect to the adoption of all animals from . s the animal shelter established under this Chapter. Notwithstanding anything in section 11- 4 -16(c) or (e), upon adoption of any animal eligible for adoption from the animal shelter, and payment of the adoption fees therefore, the animal shall be either spayed or neutered by a licensed veterinarian at the animal shelter or shall be transported to a licensed veterinarian by the Director of Animal Control, or by such employees or volunteers as are authorized to do so by the Director, to be spayed or neutered prior to release to the person adopting the animal. (c) No animal adopted from the animal shelter shall be released by the animal shelter to a person adopting the animal without it first having been spayed or neutered. Any licensed veterinarian participating in the spay /neuter program established under section 11- 4 -16(e) shall be authorized to also participate in theprogram established by this section. The City shall reimburse each participating veterinarian for each animal spayed or neutered, at the same rates of reimbursement applicable under section 11- 4- 16 -(e) and participating veterinarians shall accept such reimbursement without further charge for such procedure to the person adopting the animal. SECTION 3. The sum of $25,000.00 will be appropriate d Account No. 001 - 009 - 900 -0901 and transferred t o 0020 (Professional Services) and to be used, for Section 2 of this Ordinance. from the Prior Year Fund Balance Account No. 01- 100 - 118 - 000 -030- the specific program established in This Ordinance shall become effective upon final passage and approval.
