AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -3 TO B -2 COVERING
A PARCEL OF LAND COMMONLY KNOWN AS SOUTHEAST CORNER THATCHER
AVENUE AND AVOCADO STREET SUBJECT TO CONDITIONS SUBSEQUENTLY
BEING MET
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that;
SECTION 1.
The zoning restrictions covering the following described property be changed from
R -3, One and Two - Family Residential District, to B -2, Subregional Business District, and
upon passage of this ordinance, zoning restrictions affecting B -2, Subregional Business
District, shall apply to said property:
South 137.3 feet of North 156.3 feet excluding East 75 feet of Lot 1, Block 1,
W.D.B. Land Company Subdivision No. 1,
and more commonly known as:
Southeast corner Thatcher Avenue and Avocado Street.
SECTION 2.
With the recommendations of the Planning and Zoning Commission, this zoning
ordinance is approved with the following conditions:
1. The property owners shall convey to the City by general warranty deed a five -
foot strip of property abutting Avocado Street for public right -of -way purposes;
2. The property owner shall convey to the City a five -foot easement adjacent to
Avocado Street for a public sidewalk; and
3. The property owner shall construct the necessary public improvements to widen
that portion of Avocado Street which is adjacent to the above - described property.
The City Planning and Zoning Commission is hereby authorized and directed to
initiate proceedings to rezone the above - described property to an R -3, One and Two -
Family Residential District, if the property owners or his heirs, successors or assigns fail
to meet these conditions within twelve (12) months of passage of this ordinance.
SECTION 3.
This ordinance shall become effective immediately upon final passage and
approval.
