HomeMy WebLinkAbout06416ORDINANCE NO. 6416 AN ORDINANCE AMENDING CHAPTER 7 OF TITLE XVI OF THE PUEBLO MUNICIPAL CODE RELATING TO SEWER USE REGULATION AND PROHIBITED WASTES AND PROVIDING PENALTIES FOR VIOLATION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicates matter being deleted; underscoring indicates new matter being added.) SECTION 1. Section 16 -7 -8 of Chapter 7 of Title XVI of the Pueblo Municipal Code, as amended, is hereby amended to read as follows: 6 -7 -8. Laboratory testing. All laboratory tests to measure five -day biochemical oxygen demand and suspended solids shall be in accordance with the [methods and] procedures [set forth in the latest edition of "Standard Methods for the Examination of Water and Wastewater," American Public Health Association, New York, New York. ] established by the approval authority pursuant to Section 304 (g) of the Clean Water Act, 33 U.S.C. §1314 (g) and contained in 40 CFR Part 136 and amendments thereto, or with any other test procedures approved by the approval authority. .qFr.TinN 9 Section 16 -7 -13 of Chapter 7 of Title XVI of the Pueblo Municipal Code, as amended, is amended by amending paragraphs (3) and (9) thereof to read as follows: Sec. 16 -7 -13. Prohibited waste. It shall be unlawful for any person to discharge any of the following substances into the City's sewer system: (3) Acidity with a [daily average] pH of less than 6.4 acidity or exceeding a maximum temporary variation of pH to not less than 5.0 or wastewater having any other corrosive property capable of causing damage or hazard to structures, equipment and /or personnel of the POTW. The duration of any temporary variation shall not exceed thirty (30) minutes in any eight -hour work shift. At no time shall the pH be less than 5.0. (9) For discharges into the system, the daily maximum concentrations for the following parameters which exceed the values listed below for each parameter: Parameter mg/I Arsenic (total) 1.9 Benzene 0.05 BETX .750 Cadmium (total) 3.0 Chromium (total) 73.9 Chromium Cr" 104.9 Copper (total) 66.0 Cyanide (total) 3.6 Lead (total) 8.3 Mercury (total) 0.0027 Nickel (total) 15.1 Selenium total 1.076 Silver tots 126 Zinc (total) 129.9 As used in paragraph (9) above, daily maximum concentration means the maximum allowable concentration for each parameter during any calendar day. BETX shall be measured as the sum of benzene, ethylbenzene, toluene and xylenes. SR - TInN It shall be unlawful and a municipal offense for any person, firm, partnership, corporation or limited liability company to violate, disobey, omit, neglect, refuse or fail to comply with or resist the enforcement of any provision of this Ordinance. Any person found guilty of a violation of this Ordinance shall be punished as provided in Section 1 -2 -1 of the 1971 Code of Ordinances, as amended. In addition thereto, the City is authorized to enforce this Ordinance through the exercise of any one or more of the remedies set forth in Sections 16- 9 -13(h) and 16 -9 -14 of the Pueblo Municipal Code, as amended, which remedies are hereby expressly declared to be cumulative, the exercise of any one or more not constituting any bar or limitation to the exercise of any other. SECTION 4. This Ordinance shall become effective thirty days after final passage and approval or upon approval by the United States Environmental Protection Agency whichever occurs later.
