Copy 2/22/99 As Amended ORDINANCE NO. 6414 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -4 AND R -3 TO B -3 COVERING A PARCEL OF LAND COMMONLY KNOWN AS 2822 NORTH ELIZABETH STREET, 520 W. 29 STREET, 502 W. 29 STREET AND LAND SOUTH OF 502 W. 29 STREET, SUBJECT TO CONDITION SUBSEQUENTLY BEING MET BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1 The zoning restrictions are changed from B-4, Regional Business District, and R -3, One and Two - Family Residential District, to B -3, Highway and Arterial Business District, for the following described properties: The north 25 feet of Lot 7, and all of Lots 8 and 9, Block 1, in Clevenger's resubdivision, according to the recorded plat thereof, filed for record May 13, 1948, County of Pueblo, State of Colorado, and Lots 4, 5, 6 and the South 25 feet of Lot 7, Block 1, Clevenger's Resubdivision, County of Pueblo, State of Colorado; and Lots 10, 11 and the north 20 feet of Lot 12, Block 1, Clevenger's Resubdivision, County of Pueblo, State of Colorado. R -3 TO B -3 The south 30 feet of Lot 12 and all of Lots 13, 14, 15, 16, 17 and 18, Block 1, Clevenger's Resubdivision, County of Pueblo, State of Colorado. and more commonly known as: 2822 North Elizabeth Street, 520 W. 29th Street, 502 W. 29th Street, and Land South of 502 W. 29th Street. SECTION 2 This ordinance is contingent upon the property owners completing the improvements required by the traffic plan approved by the City Planning and Zoning Commission on February 10, 1999, which included the widening of 29th Street to five lanes from Elizabeth Street to Interstate 25. The Planning and Zoning Commission is authorized to initiate proceedings to rezone the above described properties to their original zone districts if the property owners, or their heirs, successors or assigns fail to fully comply with this condition by March 1, 2000. The City will commit to pay or Qbtain funding for up to one -half of the costs, but not to exceed $75,000 for construction of improvements to 29 Street, Pueblo, Colorado, required by the traffic plan. SECTION 3 This ordinance shall become effective immediately upon final passage and approval.
