ORDINANCE NO. 6386
AN ORDINANCE DEDICATING A PERPETUAL EASEMENT IN
GROSS FOR SANITARY SEWER PURPOSES
WHEREAS, the City of Pueblo, a Municipal Corporation, is the owner of a parcel of real
property located within the County of Pueblo and State of Colorado described as:
Blocks 9, 12, 26, 32, 42, 50 and 57 in Irving Park,
according to the recorded plat thereof, filed for record May 3, 1890,
hereinafter referred to as the "Property"); and
WHEREAS, the City Council finds and determines that a portion of the Property should be
dedicated as a sanitary sewer easement for perpetual use;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
The City Council hereby dedicates a perpetual easement in gross for the purpose of
constructing, operating, maintaining, repairing and replacing publicly -owned sanitary sewer lines and
facilities in, through, over, under and across the Property, said easement being particularly described
as:

SECTION 2
This City reserves the right to use and occupy the Property for any purpose not inconsistent
with the easement dedicated herein, provided that no building or other permanent structure shall be
erected upon the easement dedicated herein.

SANITARY SEWER OUTFALL
(20 foot R.O.W.):
An easement through a portion of blocks 9, 12, 26, 32, 42, 50, and 57 in Irving Park, according
to the recorded plat thereof, filed for record May 3, 1890, being 20 feet in width, 10 feet on each
side of the following described centerline:
Considering the South line of the NW1 /4 of Section 15, Township 20 South, Range 65 West of
the 6th P.M. to bear S. 88 °43'53 " "W. and all bearings contained herein being relative thereto.
Commencing at the Northwest corner of said Irving Park; thence Easterly, along the North line of
said Irving Park, a distance of 28.95 feet, more or less to the centerline of the proposed sanitary
sewer and the True Point of Beginning of the easement centerline herein described; thence
Southeasterly, along said sewer centerline following three (3) courses:
1. 5.41 °53'07 "E., a distance of 343 feet, more or less;
2. 5.30 °30'40 "E., a distance of 2400.00 feet;
3. S.3 8 ° 3 6' 15 "E., a distance of 796.85 feet, more or less to the center of an existing sanitary
sewer manhole at the intersection of West 21 st Street and Adee Avenue and the Point of
Terminus.

Should the City Council dedicate a perpetual easement for a sanitary sewer pipeline
within property currently owned by the City, located west of and adjacent to
Wildhorse /Dry Creek between W. 21st Street and W. 26th Street.
RECOMMENDATION
Approval of the Ordinance.
BACKGROUND
The area at the southeast comer of Pueblo Boulevard and Highway 50 West has
recently been subdivided as Southern Colorado Medical Center, Filing No. 1. This
Ordinance will authorize the dedication of a twenty foot (20') wide sanitary sewer
easement within City property for a sanitary sewer which will serve this development as
well as future development within the northwest quadrant of the City. The construction
will conform to the approved Master Plan and Construction Plans.
FINANCIAL IMPACT
Owner will finance the construction of the project. City will operate and maintain the
system.
