HomeMy WebLinkAbout06366Reception 1252252 12/04/1998 ORDINANCE NO. 6366 AN ORDINANCE ANNEXING THE AREA COMMONLY KNOWN AND DESCRIBED AS 3040 E. 4TH STREET WHEREAS, the City Planning and Zoning Commission has recommended that the area described in Section 1 hereof be annexed to the City of Pueblo; and WHEREAS, the City Council has heretofore found and determined by Resolution that the Petition for Annexation and the area described in Section 1 hereof to be in compliance with the notice and other applicable provisions of the Municipal Annexation Act of 1965 and C.R.S. § 31-12-104,105 and 107 (1); and WHEREAS, the City Council has by Resolution found and determined that an election is not required under C.R.S. §31 -12 -107 (2) and no additional terms and conditions are to be imposed upon the area described in Section 1 other than those set forth in the Petition for Annexation and the Annexation Agreement; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1 The following described area situated in Pueblo County, Colorado, is hereby annexed to Pueblo, a Municipal Corporation, subject to the terms and conditions set forth in the Petition For Annexation, and the Annexation Agreement which is hereby approved, and the official map of the City shall be amended to show such annexation: A parcel of land including the exception described in that Warranty Deed filed for record February 3, 1997 in Book 2966 at page 356 and 357 in the records of the Pueblo County Clerk and Recorder, which reads as follows: A parcel of land, situated in the NE 1/4 of the NE 1/4 of Section 33, Township 20 South, Range 64 West of the 6th P.M., County of Pueblo, 1 11111111111111111111111111111111111111111111111111 III 52232 12/04/1998 03:08P ORD Chris C. State of Colorado, more particularly described as follows: Beginning at a point on the West line of the said NE 1/4 of the NE 1/4, said point being 168.30 feet South of the NW corner of the said NE 1/4 of the NE 1/4 ; said point also being on the Southerly right -of -way line of Colorado State Highway No. 96, as presently located; thence Easterly along said right -of -way line, along the arc of a curve to the right, having a radius of 1587.10 feet, a distance of 453.80 feet; thence continuing along said right -of -way line, South 29 deg. 07 min. 30 sec. East, a distance of 279.80 feet to a point on the North line of a vacated old County Road; thence South 01 deg. 41 min. East, a distance of 30 feet to a point on the centerline of the said vacated County Road; thence Westerly, along said centerline of the vacated County Road, a distance of 579.47 feet, more or less, to a point on the said West line of the NE 1/4 of the NE 1/4 ; thence North 00 deg. 05 min. East, along said West line of the NE 1/4 of the NE 1/4 a distance of 317.78 feet to the Point of Beginning, Pueblo County, Colorado. Said parcel contains 3.74 acres more or less. SECTION 2. Within thirty (30) days after the effective date of the Ordinance, the City Clerk shall: (a) File one copy of the annexation map with the original of this ordinance in the office of the City Clerk; (b) File two certified copies of this Ordinance and annexation map with the Pueblo County Clerk and Recorder; (c) File one certified copy of the annexation map and this Ordinance with the Southeastern Colorado Water Conservancy District. SECTION 3. The City Council hereby consents to the inclusion of the annexed area in the Southeastern Water Conservancy District pursuant to C.R. S. §37 -45 -136. (3.6). SECTION 4. This Ordinance shall become effective immediately upon final passage and the annexation shall be effective for ad valorem tax purposes on and after January 1, 1999 1252252 12/04/1998 03:08P ORD Chris C.
