AN ORDINANCE AMENDING CHAPTERS 5 AND 7 OF TITLE
XVII OF THE 1971 CODE OF ORDINANCES OF THE CITY OF
PUEBLO RELATING TO ZONING AND ADMINISTRATION,
AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF
WHEREAS, the Director of the Department of Zoning Administration is authorized to issue
orders to discontinue illegal use of land, buildings or structures and other orders to ensure
compliance with or to prevent violations of the City's zoning ordinances, and
WHEREAS, a person receiving such order is required to comply therewith unless the order
is reversed or modified by the Zoning Board of Appeals after notice and hearing, and
WHEREAS, no penalty is presently imposed against a person who refuses to comply with
such orders, and
WHEREAS, the imposition of such a penalty would enhance the effective enforcement and
compliance with the City's zoning ordinances and would be in the best interest of the City and its
citizens. NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
Section 17- 5 -1(a) of the 1971 Code of Ordinances of the City of Pueblo is amended to read
as follows:
(a) The Director of the Department of Zoning Administration or his or her
authorized representative [, who] shall be the Administrative Official [, shall] authorized and
empowered to administer and enforce this Title.
SECTION 2
Section 17 -7 -3 of the 1971 Code of Ordinances of the City of Pueblo is amended by the
addition of the following new subsection (e):
(e) It shall be unlawful and a municipal offense for any person served with an
order issued by the Administrative Official pursuant to Section 17- 5 -1(b) to fail to comply
with the order within the time specified in the order. Failure to comply with an order of the
Administrative Official as herein provided constitutes a separate and independent violation
in addition to and not in substitution of any other violation of the provisions of this Title.
It shall be an affirmative defense to a violation of this Subsection (e) that the order has been
duly and timely appealed to the Zoning Board of Appeals and the Zonings Board of Appeals
has reversed or modified the order after notice and heariniz.
SECTION 2
This Ordinance shall become effective upon final passage.
