ORDINANCE NO. 6324
AN ORDINANCE AMENDING SECTIONS 7 AND 44 OF CHAPTER 4 OF TITLE XVII OF
THE 1971 CODE OF ORDINANCES OF THE CITY OF PUEBLO RELATING TO OFF -
STREET PARKING AND LANDSCAPE PERFORMANCE STANDARDS
WHEREAS, landscape performance standards enhance compatibility of adjacent
uses as well as enhance the aesthetic and environmental character and value of
surrounding neighborhoods and thereby promote the general welfare of the City; and
WHEREAS, paving and landscaping parking areas reduce dust and air pollution
emanating from parking areas; and
WHEREAS, the use of 5,000 square feet or more of land for off - street parking
without appropriate controls and landscaping detracts from and is detrimental to the
aesthetic and environmental character and value of surrounding neighborhoods.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO,

SECTION 1
Subsections (a) and (b)(2) of Section 7 of Chapter 4 of Title XVII of the 1971 Code
of Ordinances of the City be amended to read as follows:
(a) This Section is intended to provide uniform standards for the
development and maintenance of landscaping [,] required [as a result of building
permits, rezoning or subdivisions of private and public property and public right -of-
way] by the provisions of Section 17- 4- 7(b)(2)
(b)(2) Applicable Zones: The provisions of this Section shall apply in the
following zone districts: R -4, R -5, R -6, B -1, B -2, B -3, B-4, H -B, 1 -1, 1 -2, 0-1, S -1, S-4
and S -5 when any one (1) of the following occurs within the above mentioned
zone[s;] districts
a. The construction or erection of any building upon any lot;
b. Any addition of thirty -five percent (35 %) or more of the gross
square footage of an existing building [J or.
C. The use of 5.000 square feet of unimproved contiguous land
or land in the same ownership for off - street parking or the conversion of
existing use of 5.000 square feet or more of contiguous land or land in the
same ownership to off - street parking_
d. Off - street parking areas of 5.000 or more square feet shall be
paved with asphalt concrete or pavers That portion of the driveway
connecting from the curb line to the back of sidewalk property shall be paved
with concrete materials. Off - street parking areas of 5.000 or more square
feet shall meet and comply with the requirements of Section 17- 4 -44(b) (c)
(d)• (e)• (h). (i)• (J), (k) and (p).
[c.] e. The construction of any building in the specific B -4 zone district
of Downtown, Minnequa, Mesa Junction and Union Avenue, as defined on
the map, which does not allow for the required ten -foot landscape setback,
shall be required to plant street trees in the public right -of -way whenever
possible.
f. The provisions of paragraph (c) above shall not apply to
improved off - street parking areas of 5.000 or more square feet existing and
in use on June 22, 1998.
SECTION 2
Since the City Downtown General Improvement District has been dissolved and only
one parking facility located at 8th and Court Streets, Pueblo, Colorado was installed,
subsection (a)(2) of Section 44 of Chapter 4 of Title XVII of the 1971 Code of Ordinances
of the City of Pueblo is hereby repealed:
[(2) If the land and use are located within the jurisdictional boundaries of
the City Downtown General Improvement District, the City Council may, after receipt
of recommendation from the Planning and Zoning Commission upon an application
filed and processed in the same manner as an application for amendment to the
zoning map pursuant to Chapter 6 of this Title, grant a variance in the required
number of off - street parking spaces for the land in use. In the granting of such a
variance, the City Council may take into consideration the following factors:
a. The general planning of the City with respect to land use,
density parking, traffic and off - parking facilities in the City Downtown General
Improvement District;
b. The effect strict adherence to the requirements of this Section
would have on the appropriate development of the land and use;
C. The availability of adequate off - street parking, both in number
of spaces and distance from the intended use; and
d. The public welfare and interest of the City and surrounding
area.]
SECTION 3

This Ordinance shall be effective immediately upon final passage.
SECTION 4
In the event any provision of this Ordinance shall be held invalid or unenforceable
by any court of competent jurisdiction, such holding shall not invalidate or render
unenforceable any other provision hereof.
