All easements within Lot 1 of H. Salt Esquire Subdivision as recorded in Book 1771 at Page 391, City of Pueblo, County of Pueblo, State of Colorado, are hereby vacated. SECTION 2. This ordinance shall become effective immediately upon final passage and approval. V- 98 -3 -- EASEMENT VACATION REQUEST 1300 BLOCK SOUTH PRAIRIE AVENUE SYNOPSIS BACKGROUND: The applicant proposes to vacate an existing utility easement to accommodate development (Walgreen's). ISSUES: No significant issues have been identified with this request. New easements are provided in an approved subdivision. Approval of the proposal will promote development of the property. RECOMMENDATION: The Commission recommends approval by a 6 -0 vote. The vacation will not interfere with pedestrian or traffic flow. The vacation will not impact the general planning of the City. The applicant proposes to vacate a 5 -foot utility easement to accommodate development of a Walgreen's Drug Store. The property is located on the west side of the 1300 block Prairie Avenue and formerly contained several commercial uses. No significant issues have been identified with this request. New easements are provided in a new Subdivision of the area (Case No. S- 97 -27 -- Sierra Subdivision). CONCLUSION Approval of the proposal will promote development of the property. PUBLIC HEARING MINUTES (MARCH 11 1998 SPECIAL MEETING) Jim Priereschi, JR Engineering, apologized to the Commission for being late. He said they were requesting vacation of the easements to replat the land for a Walgreen's store. the easements have been reconfigured to fit the new plat. No one else appeared to be heard. Chairman Mabie made the staff report a part of the record and closed the hearing. COMMISSION DECISION (MARCH 11 1998 REGULAR MEETING) Mr. Ring, seconded by Mr. Vigil, moved to recommend approval. Motion carried 6 -0. Salt Esquire Subdivision. The existing utilities within this easement will be removed or relocated with the development of the Walgreens site. Easements were dedicated by the Sierra Subdivision Plat, to accommodate the relocated public utilities, per the improvement plans for same.
