HomeMy WebLinkAbout06308ORDINANCE NO. 6308 AN ORDINANCE AMENDING SECTION 406 OF CHAPTER 1 OF TITLE XI OF THE 1971 CODE OF ORDINANCES OF THE CITY OF PUEBLO RELATING TO TRESPASS AND IMPOSING PENALTIES FOR THE VIOLATION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate matter to be omitted, underscoring indicates new matter.) SECTION 1. Sec. 11 -1 -406 of the 1971 Code of Ordinances is hereby amended to read as follows: ((a) It shall be unlawful and a Class 2 municipal offense for any person without the permission or consent of the owner or lawful occupant thereof to enter or remain in or upon any private structure or building which is locked, boarded up or fenced in a manner designed to exclude intruders or upon the premises of a hotel, motel, warehouse, office building, apartment or condominium building. (b) This Section shall not be applicable to be unlawful entry of a motor vehicle or dwelling.] U It is unlawful and a Class 2 municipal offense for my person to enter or remain upon the premises of another when consent to enter or remain is absent, denied, or withdrawn by the owner, occupant, or person having lawful control thereof. It shall be .prima facie evidence that consent is absent, denied, or withdrawn to enter or remain upon the premises of another when: Any person fails or refuses to remove himself from said premises when requested to leave by the owner, occupant or person having lawful control thereof, or W Such premises are locked, boarded up or fenced or otherwise enclosed in a manner designed to exclude intruders. or, M Such premises are not open to the public and are posted with conspicuous signs that give notice that entrance therein is forbidden. "Conspicuous signs" means signs that are at least one (1) square foot in size and sufficiently lighted to be clear and visible and posted in a conspicuous location. (c) For the purpose of this Section "premises" means my privately or publicly owned building or structure but shall not include motor vehicles or dwellings. SECTION 2.
