All of the 10 foot public utility easement lying between Lots 4 and 5, Block 6, University Park Subdivision, 18th Filing, according to the recorded plat thereof, filed for record April 14, 1989 in Book 2442 at Page 550 in the Office of the Pueblo County Clerk and Recorder except for the Southerly 5 feet thereof, is hereby vacated. SECTION 2. V- 98 -1 -- UTILITY EASEMENT VACATION 1 VINCA COURT SYNOPSIS BACKGROUND: The applicant requests the vacation of a 10 -foot utility easement to allow two lots to be combined into one building site. ISSUES: No significant issues have been identified by staff. Approval of the proposal will promote development of the property. RECOMMENDATION: The Commission recommends approval by a 7 -0 vote. GENERAL INFORMATION Applicant: The Drawing Room Owner of Property: Same Location: 1 Vinca Court Existing Zone: R -2 /Single- Family Residential (See Attached ZONING /LOCATION MAP) Request: Easement Vacation. Purpose: Combine two lots into one building site. Existing Land Use: Undeveloped Land. Surrounding Land Use /Zoning: NORTH -- Single Family Residences /R -2 SOUTH -- Vacant Land /R -2 EAST -- Single- Family Residences /R -2 WEST -- Single - Family Residences & Vacant Land /R -2 211 E. Transportation: The vacation will not interfere with pedestrian or traffic flow. Planning: The vacation will not impact the general planning of the City. ANALYSIS The applicant proposes to vacate a 10 -foot utility easement to allow two lots to be combined into one building site. The property is located at the southeast corner of the intersection of Castor Drive and Vinca Court in a developing area of the University Park neighborhood. The surrounding area consists of single - family residences to the east with the remainder being vacant land and residences under construction. A 20 -foot public utility and drainage easement exists adjacent to the site which can accommodate development. No significant issues have been identified with this request. STAFF CONCLUSION Approval of the proposal will promote development of the property. PUBLIC HEARING MINUTES (FEBRUARY 11, 1998, SPECIAL MEETING) Bobbie Rooney, The Drawing Room, appeared before the Commission and said their client was requesting the easement be vacated between Lots 4 and 5 so they could construct a house across this easement. The property will still retain a 10 -foot utility easement between Lots 3 and 4. No one else appeared to be heard. Chairman Mabie made the staff report a part of the record and closed the hearing. COMMISSION DECISION (FEBRUARY 11, 1998, REGULAR MEETING) Mr. Verna, seconded by Mr. Vigil, moved to recommend approval. Motion carried 7 -0. The Drawing Room is the contractor for the proposed home. It is the home owner desire to place the home on both Lot 4 & Lot 5 over the lot line, therefore, also over the easement. The easement was originally placed for utility service lines for Lot 4. The address for Lot 4 is 4808 Castor Drive or 1 Vinca Court depending on which way the proposed home will be set.
