A RESOLUTION GRANTING AN EASEMENT DEDICATION
FOR UTILITY PURPOSES ON LOT 7, BLOCK 1,
HISTORICAL ARKANSAS RIVERWALK PROJECT, FILING
NO. 1
WHEREAS, the construction of the new fountain adjacent to Lot 7, Block 1, of the
Historical Arkansas Riverwalk Project, Filing No. 1, required the placement of
underground power and water lines across a portion of said lot, and
WHEREAS, an easement dedication is required to reserve that portion of said lot
for utility purposes.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Easement Dedication, a copy of which is attached hereto, after having been
approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The President of City Council is hereby authorized to execute said Easement
Dedication on behalf of the City of Pueblo, and the City Clerk is directed to file the
executed agreement in the Office of the Pueblo County Clerk and Recorder.

ISSUE
Should City Council grant an Easement Dedication for public utility purposes on
Lot 7, Block 1, Historical Arkansas Riverwalk Project, Filing No. 1.
RECOMMENDATION
Approval of this Resolution.
BACKGROUND
Because of the construction of the new fountain adjacent to Lot 7, Block 1, of the
Harp Subdivision, Filing No. 1, a 10 -foot wide utility easement is required for
underground electric and water lines. This Easement Dedication will establish
said easement and reserve this strip of land for utility purposes.
FINANCIAL IMPACT
None.

EASEMENT DEDICATION
The City of Pueblo, a municipal corporation, whose address is 1 City Hall Place, Pueblo,
Colorado, 81003 (the "Grantor "), as record owner in fee simple of Lot 7, Block 1, Historical
Arkansas Riverwalk Project, Filing No. One, Pueblo County, Colorado, does hereby dedicate to
the public a ten (10) foot wide utility easement in, through, over, under, and across said Lot 7
parallel to and offset two (2) feet from the westerly right -of -way of Grand Avenue, as shown on
the attached Exhibit "A" (the "Easement ").
Grantor hereby reserves the right in its sole discretion to modify, revoke, terminate, or
cancel this Easement, in whole or in part, at any time, by instrument recorded in the office of the
Pueblo County Clerk and Recorder.
Grantor further reserves the right in its sole discretion to control and restrict the use of the
Easement, including the right to arbitrarily deny the use thereof by any person, utility company,
franchisee, or the Board of Water Works of Pueblo, Colorado.
Grantor further reserves the right to use and occupy the Easement for any and all
purposes not inconsistent with the rights and privileges above granted.
