CODE OF ORDINANCES OF THE CITY OF PUEBLO RELATING TO MECHANICAL REGULATIONS; ADOPTING THE 1997 EDITION OF THE UNIFORM MECHANICAL CODE, PUBLISHED BY INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, 5360 SOUTH WORKMAN MILL ROAD, WHITTIER, CALIFORNIA 90601- 2298; AND RENUMBERING SECTIONS AND CHAPTERS TO REFLECT THE NEW CODE FORMAT. BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO that: (Brackets indicate matter being deleted; underscoring indicates new matter being added.) SECTION 1. Section 4 -5 -1 of Chapter 5, Title IV of the 1971 Code of Ordinances, as amended, is hereby amended to read as follows: 4 -5 -1: UNIFORM MECHANICAL CODE - ADOPTION BY REFERENCE The Uniform Mechanical Code, 19[88197 Edition, including all appendices, promulgated and published by the International Conference of Building Officials, 5360 South Workman Mill Road, Whittier, California 90601, [and the International Association of Plumbing and Mechanical Officials, 20001 South Walnut Drive, Walnut, California 91789,1 referred to as the Uniform Mechanical Code or U.M.C., as amended by this Chapter, and subsequent U.M.C. supplements, is adopted and enacted by reference provided, however, that the following portions of the U.M.C. are not adopted and are expressly deleted: Sub - Section 303.1.2 entitled Floor Furnace, Section 607 entitled UNDER -FLOOR SPACE USED AS PLENUMS, Section 1028 entitled MAINTENANCE INSPECTION and 1312.5 Drip Pipes. [Section 304(b), (c), and (e); Table No. 3 -A, Page 12 and 13 relating to Mechanical Permit Fees; Section 804, on page 56 entitled "Floor Furnaces "; Section 1008 being page 84 and 85 entitled "Use of Underfloor Space as Supply Plenum".] Copies of this Code are available in the office of the Pueblo Regional Building Department for distribution and sale to the public. The regulation, design, control, construction, installation, quality of materials, location, operation, alteration, repair and maintenance of heating, ventilating, cooling, refrigeration systems, incinerators and other miscellaneous heat - producing appliances or parts thereof within the City of Pueblo shall be in compliance with the terms and provisions of this Chapter and the Uniform Mechanical Code, 1997 Edition, except as same may be excluded from and specifically not covered by this Chapter and said Uniform Mechanical Code. SECTION 2 Section 4 -5 -2 of Chapter 5, Title IV of the 1971 Code of Ordinances, as amended, is hereby amended to read as follows: 4 -5 -2: AMENDMENTS (1) Section 1201(a)] 108.1 General. of the U.M.C. is amended to read as follows: [Powers and Duties of Building Official Section 201(a) General. The Building Official is authorized and directed to enforce all the provisions of this code. This code shall be under the jurisdiction of the Pueblo Regional Building Department. The Chief Mechanical Inspector or in his absence the building official whose duties and responsibilities are set forth in Title IV of the 1971 Code of Ordinances shall enforce the provisions of this code.] Administration and enforcement of this Code and all related codes are delegated to the Pueblo Regional Building Department Wherever in this code the phrase "Building Official" appears, it shall be constructed to refer to the Director of the Pueblo Regional Building_ Department or the Building Official's duly authorized representative. (2) Section 1201 (b)] 108.2 Deputies of the U.M.C. is amended to read as follows: [Sec. (b)] 108.2 Deputies: Whenever the term "authorized representatives" appears, it shall be construed to refer to "Regional Building Department Mechanical Inspectors ". (3) Section [204] 111. Violations. of the U.M.C. is amended by the addition of the following [paragraph] subsection 111.2 "Penalties" to read as follows: 2 Sec. 111.2 Penalties. Any person, firm or corporation violating any of the provisions of this code or said Chapter 5 shall upon conviction thereof be punished as provided in Section 11-2-11 of the 1971 Code of Ordinances of Pueblo. The application of any such penalty shall not be held to prevent the enforced removal of prohibited conditions. 1(4) Section 302 of the U.M.C. is amended by the addition of the following new subsection (d): (d) No permit required by this code shall be issued by the Pueblo Regional Building Department to any person unless such person is duly licensed or certified as provided in Title IV of Chapter 3 of the Code of ordinances of the City of Pueblo.] [(5)] W Section 1304 (a)] 115.2 Permit Fees. of the U.M.C. is amended to read as follows: Section 1304 (a)] 115.2 Permit Fees. [The fee for each permit shall be paid to the Pueblo Regional Building Department as set forth by resolution of the City Council. ] Fees shall be as set forth in the fee schedule adopted by the City- (5) Section 115.3 Plan Review Fees. of the U.M.C. is amended to read: Fees shall be as set forth in the fee schedule adopted by the City. (6) Section [502] 302.1 Listed Equipment of the U.M.C. is amended by the addition of the following paragraph: No open face circulating heater or gas log type heater shall be hereafter installed in the City unless they have been approved by Underwriters Laboratories or American Gas Association, or other recognized approved agencies. Before a furnace or boiler is given final approval, all controls and wiring shall be complete, and the controls shall be connected and in operation. Cold and warm air ducts shall be completely installed. [All log lighters hereinafter installed shall be equipped with an approved timer. ] 3 (7) Section [709 -3] 303.1.2 Floor Furnaces of the U.M.C. is amended [by the ,addition of the following] to read as follows: [, and shall be connected with an approved listed metal appliance connector.] All replacements of floor furnaces are prohibited in this jurisdiction. (8) Section [803-41 Prohibited Locations of the U.M.C. is amended by the addition of following: [All gas logs shall be equipped with a pilot.] A liquefied petroleum gas appliance excluding hot water heating appliances, that are a sealed unit may be installed below grade. Sealed unit means any unit that has no openings in the below grade area, brings its combustion from outside the building and vents to the outside of the building in an approved manner. (9) Section [804] 317.1 Equipment under Floors of the U.M.C. is amended by the addition of number 5 to read as follows: [Sec. 804 Floor Furnaces. All floor furnaces are banned.] 5. All access openings to underfloor furnaces shall be provided with a permanent ladder for equipment access. All underfloor furnaces shall be connected with an approved oved listed metal appliance connectors. (10) Section 311.1 General of the U.M.C. is amended by the addition of the following sentence to read as follows: All "gas logs" shall be equipped with a pilot. All "gas logs lighters" shall be equipped with an approved timer. (11) Section 403.1 General of the U.M.C. is amended by the addition of the following sentence to read as follows: Fresh air shall be provided to all new heating systems a minimum of 11 twenty- eight (28) square inches. (12) Section 504.3.2 Length limitation of the U.M.C. is amended to read as follows: Unless otherwise permitted or required b, the he dryer manufacturer's installation instructions and approved by the building official, domestic dryer moisture exhaust ducts shall not exceed a total combined horizontal and vertical length of thirty (30) feet, including three (3 9) 0- degree elbows. Two feet shall be deducted for each 90- degree elbow in excess of three (3). (13) Section 508.4 Clearance for Type I Hood of the U.M.C. is amended by the addition of the following sentence: Kitchen hoods must maintain a minimum of 6'5" height from lower edge of hood to floor. (14) Section 509.7 Manual System Operation of the U.M.C. is amended by the addition of the following paragraph: A readily accessible means to manuals activate a fire extinguishing _s sY tem• except a sprinkler system, shall be provided in a Bath of exit or egress and shall be clearly identified The operation of any extinguishing system shall automatically shut off all sources of fuel and heat to all equipment protected by an extinguishing system or located under ventilating equipment protected by an extinguishing shing system Automatic valves or cut -off devices shall be readily accessible for resetting or replacement. (15) Section 12004 (b)] 601.5 Factory -made Air Ducts of the U.M.C. is amended by the addition of the following sentence [paragraph] : [A readily accessible means to manually activate a fire extinguishing system, except a sprinkler system, shall be provided in a path of exit or egress and shall be clearly identified. The operation of any extinguishing system shall automatically shut of all sources of fuel and heat to all equipment protected by an extinguishing system or located under ventilating equipment protected by an extinguishing system. Automatic valves or cut -off devices shall be readily accessible for resetting or replacement. ] Flexible duct shall be limited in length to a maximum of fifteen 0 5 feet. (16) [Subsection (a) of Section 21071 Section 801.1 Venting Systems Required of the U.M.C. is amended by the addition of the following paragraph: Category I appliance venting systems designed and installed to comply with the manufactures listing and the GAMA (Gas Appliance Manufacturer's Association) Venting Tables, shall be identified on the appliance with a locally prepared label provided by the installer. The label shall state that the installation complies with the GAMA venting requirements and have the address of the installation firms name, telephone number, and signature of the firm's examinee displayed there on This label shall be affixed prior to final inspection (17) Section [2109] 1012 Shutoff Valves of the U.M.C. is amended by the addition of the following: Approved main burner safety shut off valves shall be required on all boilers where the burner input is in excess of 400,000 B.T.U. An additional spring loaded type solenoid gas valve or hydromotor type gas valve shall be installed when a diaphragm type gas valve is installed. Any change in existing safety shut -off valves will require compliance with this section. (18) [Section 2213 (c) Drip Pipes is deleted.] Section 1314.1 General of the U M C is amended by the addition of number 10 to read as follows: Liquefied petroleum forced air heating appliances, excluding hot water heating appliances that are sealed units may be installed below grade. Sealed unit means any unit that has no opening in the below grade unit, bringing its combustion from outside the building and vents to the outside of the building in an approved manner. [(19) Section 2219 of the U.M.C. is [hereby] amended by the addition of the following new subsection (d): (d) Required Gas Piping Size. Gas Utilization standards for house piping shall be as follows: TABLE I GAS UTILIZATION STANDARDS HOUSE PIPING SIZING HOUSE PIPING Computing Sizes of House Piping (Example for Steel) Gas piping shall be of such size as to provide a supply of gas sufficient to meet the maximum demand of all appliances. The following procedure should be used to compute house piping sizes from the 0.3" W. C. tables: 1. Determine the gas demand in cubic feet per hour for each outlet by using the nameplate input rating adjusted for high altitude using the formula described under "Appliance Input Ratings ". 2. Measure the length of piping from the gas meter to the housing piping outlet which is the farthest from the meter. 3. Select the horizontal line showing the farthest distance or the next longer distance if the table does not give the exact distance. This horizontal line (farthest distance) shall be used. in sizing all sections of pipe in the piping system. 4. Starting at the farthest outlet from the meter, find the gas demand for that outlet. If the exact gas demand figure is not shown, choose the next largest figure in the same horizontal line. 5. Opposite this demand figure (in the column headed "Nominal Iron Pipe Size -Inches") the minimum size of pipe to be used is indicated. This pipe size is only for that section of pipe carrying the gas demand for the outlet under consideration. 6. Proceed in a similar manner for each outlet 7 7. After each outlet has been sized, then size each section of pipe carrying the gas demand for more than one outlet. This is done by determining the total gas demand supplied by each section and using that figure in the farthest distance horizontal line as determined in step (3). House Piping Capacity Table The table on the following page shall be used for sizing house piping in the City of Pueblo. I TABLE3 GAS UTILIZATION STANDARDS BURNER ADJUSTMENT APPLIANCE INPUT RATINGS Reducing Input Ratings for High Altitude Conditions Except for high altitude approved appliances, input ratings of gas appliances are based on sea level operation. For operation of elevations above 2,000 feet, input ratings shall be reduced at the rate of 4% for each 1,000 feet of elevation above sea level. (20) 'The U.M.C. is hereby amended by the addition of the following new Chapter 25: CHAPTER 25 STORAGE WATER HEATERS Section 2501. General_ In addition to the general requirements of Chapter 5 of the U.M.C., every water heater shall be installed to conform to the requirements of this Chapter. Section 2502. Permits. It shall be unlawful for any person to install, remove or replace any water heater without first obtaining a permit from the Pueblo Regional Building Department to do so. Section 2503. Installation Requirements. Proper provisions shall be made for an adequate supply of air for combustion and ventilation as specified in Chapter 6 of the U.M.C. Insulated gas -fired domestic water heaters shall be provided with, in addition to, the primary temperature controls, an over temperature safety relief valve, listed and installed in accordance with recognized standards. Every water heater designed to be vented shall be connected to such system and shall comply with provisions specified in Chapter 9 of the U.M.C. Section 2504. All water heater installations shall comply with Section 704 of the U.M.C. EXCEPTION: Replacement of existing water heaters shall be by approval of the chief mechanical inspector. Section 2505. All water heaters located in underfloor spaces shall be installed as per Section 709.1 SECTION 3. Section 4 -5 -3 is created to read as follows: 4 -5 -3: OFFENSES; CRIMINAL PENALTIES; PERMIT REVOCATION; OTHER ENFORCEMENT (a) It shall be unlawful and a Class 1 Municipal Offense for any person to knowingly violate, disobgy, omit, neglect, refuse, or fail to comply with or resist the enforcement of ay provision of this Chapter of the Uniform Mechanical Code, and upon conviction thereof the punishment therefor shall be a fine of not more than Three Hundred Dollars $300, or imprisonment for not more than ninety (90) days, or both such fine and imprisonment. ( It shall be unlawful and a Class 1 Municipal Offense for any person to refuse or fail to timely comply with any order issued by the Building Official. the Director of the Pueblo Regional onal Building- Department or other designated mechanical inspector pursuant to the provision of this Chapter of the Uniform Mechanical Code and upon conviction thereof, the punishment therefor shall be a fine of not more than Three Hundred Dollars ($300) or imprisonment for not more than ninety (90) days, or both such fine and imprisonment. (c) It shall be unlawful and a Class I Municipal Offense for any person to knowingly make any false statement. _.representation or certification in any application, record, report plan or 10 other document filed or required to be maintained pursuant to any requirement of this Chapter or the Uniform Mechanical Code,, and upon conviction thereof, the punishment therefor shall be a fine cf not more than three hundred ($300) or imprisonment for not more than ninety (90)d days. or both such fine and imprisonment. (d) Any person issued pursuant to the provisions of this Chapter or the Uniform Mechanical Code may be suspended terminated or revoked by the Building_ Official for (1) any of t he re asons stated in subsection 114.5 of the Uniform Mechanical Code or (2) any material violation of the terms of said (e) In the event any ermit or requirements applicable thereto. or occupant of premises within the City shall refuse entry to the Building Official or any _owner building inspector, or if and premises are locked and the Building Official or any building inspector has been unable to obtain permission of the owner or occupant to enter, the Municipal Court is authorized to issue a search or inspection warrant authorizing such entry in accordance with the procedures set forth in the Colorado Municipal Court Rules (f) In the event any owner or occupant of premises within the City or any licensed contractor, or any permittee, shall fail or refuse to comply with any provision of this Chapter, the U.M C or any license or permit issued thereunder, the City may initiate an action for injunctive , reljei' in any court of competent jurisdiction to compel compliance with said Chapter. U M C license or permit. (g) The enforcement remedies set forth in this Section are expressly declared to be cumulative and the exercise of anyone or more of them is not dependant upon the exercise of any other remedy, nor does the exercise of any one of more of them constitute any bar or limitation to the exercise of am other. SECTION 4. A public hearing to consider the adoption of the Uniform Mechanical Code, 1997 Edition, with modifications, shall be held in the Council Chambers, City Hall, 1 City Hall Place, Pueblo, Colorado at 7:30 p.m. on August 25 , 1997. The City Clerk is directed to publish notice of such hearing pursuant to Section 31 -1.6 -203 of the Colorado Revised Statutes. SE CTION 5 The adoption of this Ordinance and of the Uniform Mechanical Code shall not create any 11 duty to any person, firm, corporation, or other entity with regard to the enforcement or nonenforcement of this Ordinance or said code. No person, firm, corporation, or other entity shall have any private right of action, claim or civil liability remedy against the City of Pueblo of the Building department, or their officers, employees or agents, for any damage arising out of or in any way connected with the adoption, enforcement, or nonenforcement of this Ordinance or said code. Nothing in this Ordinance or in said code shall be construed to create any liability, or to waive any of the immunities, limitations on liability, or other provisions of the Governmental Immunity Act, C.R.S. 24 -10 -101 et seq., or to waive any immunities or limitations on liability otheinwise available to the City of Pueblo or the Pueblo Building Department, or their officers, employees or agents. SEC 6. If any part, section, subsection, sentence, clause or phrase of this Ordinance or the adopted Uniform Mechanical Code is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance or of the Uniform Mechanical Code. SECT 7. The Council finds and declares that a certified true copy of the Uniform Mechanical Code, 1997 Edition, has been on file in the office of the City Clerk of the City of Pueblo for not less than 15 clays preceding the public hearing referred to in Section 11 of this Ordinance, and shall remain in said office for public inspection. After adoption of this Ordinance, a copy of the Uniform Mechanical Code shall be kept in the office of the Building Official at 316 15th St. W., Pueblo Colorado. Copies of the Uniform Mechanical Code shall be available through the Pueblo Regional Building Department for purchase by the public at a moderate price. 12 SECTION 8 This Ordinance shall become effective 30 days after final passage and approval.
