ORDINANCE NO. 6228
AN ORDINANCE AMENDING CHAPTERS 2 AND 4 OF
TITLE XVII RELATING TO BED AND BREAKFAST
FACILITIES
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
(Brackets indicate material being deleted; underscoring indicates
new material being added.)
SECTION 1
Section 1, Chapter 2 of Title XVII of the 1971 Code of
Ordinances of the City of Pueblo is amended by the addition of two
new subsections 6.4.01 and 6.4.02 which shall read as follows:
17 -2 -1 (6.4.01) Bed and Breakfast Home.
An owner occuried and operated, detached, single
family residence where no more than three quest bedrooms
are rented to the general public on a nightly basis and
where a breakfast meal is provided only to registered
quests.
17 -2 -1 (6.4.02) Bed and Breakfast Inn.
A commercial enterprise which rents more than three
guest bedrooms to the general public. Such facility may
offer meeting facilities and meals to the general public,

but would be subject to all laws and regulations
governing the operation of a restaurant.
SECTION 2
Chapter 4 of Title XVII, of the 1971 Code of Ordinances for
the City of Pueblo is amended by the addition of a new subsection
10, which shall read as follows:
17 -4 -10: BED AND BREAKFAST HOME PERFORMANCE STANDARDS
(a) ADMINISTRATION:
Any person wishing to operate a bed and breakfast home shall
upon a form provided by the City give the following
information to the Director of Zoning:
1. Proof of ownership.
2. Building layout showing locations of guest bedrooms,
common areas and owner /resident's living quarters.
3. Proposed parking_
4. Proof of compliance with all applicable State and City
health, building and fire codes.
5. Application fee as set by resolution of City Council.
(b) REGULATIONS:
1. Bed and breakfast homes operating under a special use
permit may be reviewed by the Zoning Board of Appeals
within twelve months of approval at the discretion of the

Board. The permit is subject to review by the Board on
a complaint basis as determined by the Director of
Zoning.
2. The operator shall provide and maintain a guest register.
Such register shall be available for inspection by City
officials and law enforcement authorities. The maximum
stay for guests shall not exceed 30 consecutive days.
3. The owner of a bed and breakfast home shall provide one
on site paved parking for each guest unit in addition to
the required parking for the zone district in which the
home is located. Such parking shall preserve the
residential character of the property and surrounding
neighborhood The City Traffic Engineer shall review and
approve the parking layout submitted with the
application.
4. A bed and breakfast home shall be restricted to two non-
selfilluminated signs limited to no more than four square
feet for each sign The sign(s) shall be limited to the
name address and telephone number of the bed and
breakfast home. The location and design of any sign must
be approved by the City Director of Zoning or the
Director's designee.
5. The bed and breakfast home shall be in compliance with
all applicable health, fire, building and safety
regulations. After initial approval, periodic safety and
health inspections shall be performed by inspectors from
the City /County Health Department, the Regional Building
Department and the Fire Department. Such inspections
shall also verify the following safety equipment and
measures are present or enforced:
(1) Smoke alarms are located upon all floors;
(2Z Fire extinguishers are located upon all floors;
(3) Fire escape routes are present, if deemed
necessary; and
_(4) No cooking shall be permitted in guest rooms.
(6)_ The bed and breakfast home shall acquire and maintain a
valid City of Pueblo business license.
(c) RESTRICTIONS:
All bed and breakfast homes shall:
1. Be owner occupied in a detached single family residence
with at least 1,600 square feet of net usable floor area.
2. Have no more than three guest units in the principal
structure only.
3. Have no other bed and breakfast facilities located within
150 feet of the exterior property boundaries of the home.
4. Have no exterior alterations to accommodate its use, such
as additions or additional entries.
5. Have no other commercial functions allowed such as
meetings, receptions and similar functions. Home
occupations shall not be permitted.
6. Have only a breakfast meal served only to registered
guests Dining and other facilities shall not be open to
the public.
7. Shall have a refuse area screened from the view of
persons from adjacent properties and public rights -of-

(d) OTHER FACTORS AND CONSIDERATIONS FOR APPROVAL BY THE
ZONING BOARD OF APPEALS:
All Bed and Breakfast Homes:
1. Shall not constitute an annoyance or nuisance to
surrounding residents by reason of noise, smoke, odor,
electrical disturbance night lighting r the creation of
unreasonable traffic to the premises.
2. Shall not create an adverse impact on the residential
character of the surrounding neighborhood.
3. Shall be compatible and harmonious with surrounding land
uses.
SECTION 3
Subsections 7(b), 8(b), 11.1(b) and 12(b), Section 51, Chapter
4 of Title XVII, of the 1971 Code of Ordinances for the City of
Pueblo are amended by the addition of bed and breakfast home as a
use by right as follows:
17 -4 -51 (7)(b)(6.1) Bed and Breakfast Home
17 -4 -51 (8)(b)(5.1) Bed and Breakfast Home
17 -4 -51 (11.1)(b) Uses by right.
A use by right is any use which is
primarily retail, office, commercial,
finance, transient residence, including
bed and breakfast homes, government,
service, social or cultural in nature
(including parking lot and parking
structure), which serves the public good
and which does not involve permanent
residence or the manufacture, production,
fabrication or rebuilding or the bulk
storage, warehousing or wholesaling of
merchandise, or mobile home sales

17 -4 -51 (12)(b) Uses by right.
A use by right is any use which is
primarily retail, office, commercial,
finance, transient residence, including
bed and breakfast homes, adult
entertainment, government, service,
social or cultural in nature (including
parking lot and parking structure), which
serves the public good and which does not
involve permanent residence or the
manufacture, production, fabrication or
rebuilding or the bulk storage,
warehousing or wholesaling of
merchandise. (Utilities as outlined in
Section 17- 4 -30.)
SECTION 4
Subsections 2 (c) , 3 (c) , 4 (c) , 5 (c) , 6 (c) , 10 (c) , and 11 (c) ,
Section 51, Chapter 4 of Title XVII, of the 1971 Code of Ordinances
for the City of Pueblo are amended by the addition of a Bed and
Breakfast Home as a use by review as follows:

17 -4 -51 12(b Bed and Breakfast Inn
Uses by right:
A use by right is any use which is primarily
retail, office, commercial, finance, transient
residence, including bed and breakfast inns,
adult entertainment, government, service,
social or cultural in nature (including
parking lot and parking structure), which
serves the public good and which does not
involve permanent residence or the
manufacture, production, fabrication or
rebuilding or the bulk storage, warehousing or
wholesaling of merchandise. (Utilities as
outlined in Section 17- 4 -30.)

SECTION 6
Subsections 1, 10, and 11, Section 51, Chapter 4 of Title XVII
of the 1971 Code of Ordinances of the City of Pueblo are amended by
the addition of Bed and Breakfast Inn as a use by review as
follows:
17 -4 -51 (1)(c)(2.1) Bed and Breakfast Inn

17 -4 -51 (11) (c) (3.1) Bed and Breakfast Inn
SECTION 7.
This Ordinance shall become effective immediately upon final
passage.
