AN ORDINANCE AMENDING CHAPTER 7 OF TITLE XVI OF THE
1971 CODE OF ORDINANCES RELATING TO SEWER USE REGULATION,
PROHIBITED WASTES AND INDUSTRIAL PRETREATMENT AND
PROVIDING PENALTIES FOR VIOLATION THEREOF
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicates
matter being deleted; underscoring indicates new matter being added.)
SECTION 1.
Section 16 -7 -13 of Chapter 7 of Title XVI of the 1971 Code of Ordinances, as amended,
is hereby repealed and amended by adoption of a new Section 16 -7 -13 to read as follows:
( 16 -7 -13: PROHIBITED WASTE
It shall be unlawful for any person, partnership, corporation or public or
private entity to discharge any of the following substances into the City's sewer
system:
(a) Any explosive substance.
(b) Any flammable substance with a flash point lower than 187° F.
(c) Any concentration of gases or vapors, free or occluded, which are toxic to
life.
(d) Acidity with a daily average pH of less than 6.4 acidity exceeding a
maximum temporary variation of pH to not less than 5.0. The duration of any
temporary variation shall not exceed thirty (30) minutes in any eight -hour work shift.
At no time shall the pH be less than 5.0.
(e) Any grease or oily substance in excess of 100 milligrams per liter;
provided, however, that animal or vegetable based oil or grease from approved
restaurant oil or grease traps and interceptors, if transported in accordance with
Chapter 10 of this Title, may be received at the designated receiving point of the
sewer system, in accordance with regulations to be adopted by the Director. Und,
no circumstances may bulk oil and grease be discharged into the sewer system.
(f) Any antiseptic solution greater than 100 milligrams per liter.
(g) Any substance with a temperature outside the range of 32° F - 150'F,
(h) Hydrogen sulfide, sulphur dioxide, nitrous oxide, or any halogens in
concentrations greater than 10 milligrams per liter.
(i) for discharges into the system, the daily maximum concentrations for the
following parameters which exceed the values listed below for each parameter:

0) As used in paragraph (i) above, daily maximum concentration means the
maximum allowable concentration for each parameter during any calendar day.
(k) Any substance which will solidify or become viscous at temperatures
between 32° F and 150° F.
(1) Soluble substances in concentration which increase the specific viscosity
above 1.1.
(m) Soluble substances with a specific gravity greater than 2.65.
(n) Substances of a size or nature capable of obstructing the flow of the se' er
system or interfering with the treatment plant operation.
(o) Phenols in excess of 5.0 milligrams per liter.
(p) Any oil and /or grease from recycling, reclaiming or holding containers. ]
16 -7 -13: PROHIBITED WASTE
It shall be unlawful for any person, partnership, corporation or public or
private entity to discharge any of the following substances into the City's sewer
s s� tem:
(a) Any liquid, solids or gases which by reason of their nature or quantity are
sufficient either alone or by interaction with other substances to cause fire or
explosion. Any flammable substance with a flash point lower than 187 degrees F.
Prohibited materials shall include. but are not limited to. - Pas_ oline, kerosene, naphtlin,

benzene, toluene, xvlene, ethers, alcohols, ketones, aldehydes, peroxides, chlorates,
perchlorates, bromates, carbides, hydrides, and sulfides and any other substances
which the City, the State or EPA has notified the User is a fire or explosion hazard,
(b) Solid or viscous substances which may cause obstruction to the flow in
the POTW or other interference with the operation of the POTW such as, but not
limited to: grease,garba_e with particles greater than one -half (1/2) inch in any
dimension, animal waste. guts or tissue, paunch manure, bones, hair, hides or
fleshings, entrails, whole blood, feathers, ashes, cinders, sand, spent lime, stone or
marble dust, metal, glass straw, shavings, rag ss clippings, rags. spent grains, spent
hops, waste paper, wood, plastics, gas, tar, asphalt residues, residues from refining or
processing of fuel or lubricating oil, mud, or ]g ass grinding or polishing wastes.
(c) Acidity with a daily average pH of less than 6.4 acidity or exceeding a
maximum temporary variation of pH to not less than 5.0. The duration of any
temporary variation shall not exceed 30 minutes in any 8 hour work shift. At no
time shall the pH be less than 5.0.
(d) Any noxious or malodorous liquids, gases, or solids which either singly
or by interaction with other wastes are sufficient to create a public nuisance or
hazard to life or are sufficient to prevent entry into the sewers for maintenance and
repair.
(e) Any substance which may cause the POTW's effluent or any other
product of the POTW such as residues, sludges, or scums to be unsuitable for
reclamation and reuse or to interfere with the reclamation process.
(f Any wastewater with objectionable color not removed in the treatment
process such as, but not limited to, dye waste and vegetable tanning solutions.

As used in paragraph (i ) above. Daily Maximum concentration means the

(j) Phenols in excess of 5 milligrams per liter.
(k) Any wastewater containing any radioactive waste or isotopes of such
half -life or concentration as may exceed limits established by the Director in
compliance with applicable State or Federal regulations.
Any substance which will cause the POTW to violate its NPDES Permit or
the receiving water duality standards.
(m) Any wastewater containing toxic pollutants in sufficient quantity, either
singly or by interaction with other pollutants. which injure or interfere with any
wastewater treatment process: or which constitute a hazard to humans or animals: or
which creates a toxic effect in the receiving waters of the POTW: or which exceed
the limits set forth in this Section. or Categorical Pretreatment Standards. For
purpose of this subparagraph (m). toxic pollutant shall include, but shall not be
limited to, any pollutant identified pursuant to Section 307 (a) of the Act.
(n) Any grease or oily substance in excess of 100 milli„ rams per liter:

(o) Any _petroleum oil, nonbiodepradable cutting oil or products of mineral
oil origin in amounts that will cause interference or pass through.
(p) Any antiseptic solution greater than 100 milligrams per liter.
(g) Hydrogen sulfide sulphur dioxide nitrous oxide, or any halogens in
concentrations greater than 10 milligrams per liter.
(r) Soluble substances with a specific rg avity greater than 2.65 or in
concentration which increases the specific viscosity above 1. l .
SECTION 2.
Any person who violates any provision of this Ordinance shall be subject to the
enforcement actions, remedies and penalties provided for in Chapters 7, 9 and 10 of Title XVI of
the 1971 Code of Ordinance, which enforcement actions, remedies and penalties are intended to
be cumulative; and it is hereby declared to be unlawful for any person to violate any provision of
this Ordinance and upon conviction thereof, said person shall be punished as provided in Section
1 -2 -1 of the 1971 Code of Ordinances, as amended.
SECTION 3
This Ordinance shall become effective thirty days after final passage and approval or
upon approval by the United States Environmental Protection Agency whichever occurs later.
