ORDINANCE NO. 6091
AN ORDINANCE VACATING THE EAST -WEST ALLEY
SOUTH OF 1538 SPRUCE STREET
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that:
SECTION 1.
Alley as platted in C.F. Ray's Subdivision of Lots
20, 21, 22 and 23 in Block 81, Steelton and located
immediately adjacent to Lot 19 in Block 81 in Steelton
is hereby vacated.
SECTION 2.
This ordinance shall become effective immediately upon
final passage and approval.

GRANT OF EASEMENT
f THIS INDENTURE made and entered into this day of
1996, by and between Randolph C. Prado and Genevieve
ra o, whose address is 1538 Spruce Street, Pueblo, Colorado,
hereinafter referred to as "GRANTORS", and:

Esther Warwick Cordova
511 Bay State, Pueblo, Colorado, 81004
hereinafter referred to as "GRANTEES",
WITNESSETH
For and in consideration of Ten Dollars ($10.00) and other
good and valuable consideration, the receipt and sufficiency of
which are hereby acknowledged, the Grantors grant, bargain, sell
and convey unto Grantees, their heirs and assigns forever, a
perpetual non - exclusive easement for underground water, sewer and
gas lines, in the location presently existing, beneath the vacated
alley platted and adjoining Lots 1, 2, 3 and 4, Block 81, in C. F.
Ray's Subdivision of Lots 20, 21, 22, and 23, Block 81, Steelton
Subdivision of Lots 3 and 6, Block 42, Uplands Park, Town of
Bessemer, now a part of the City of Pueblo, Pueblo County,
Colorado.
Together with the right of ingress and egress therefrom, for
all the purposes hereinabove mentioned, TO HAVE AND TO HOLD, all
and singular, the aforesaid privileges to the proper use and
enjoyment by said Grantees.
This easement is appurtenant to, and for the benefit of, the
above described lots in C.F. Ray's Subdivision.
Grantors retain the right to use and occupy the easement area
for any purpose not inconsistent with Grantees' full enjoyment of
the rights hereby granted, including but not limited to, the right
to maintain, pave and surface said vacated alley for use as a
private driveway.
This easement shall extend to and be binding upon the heirs,
successors and assigns of the parties hereto.

SPECIAL WARRANTY DEED

THIS DEED, Made this day of May, 1996, between Elissa Figueroa
of the County of Pueblo and the State of Colorado, of the f irst
part, and Randolph C. Prado and Genevieve Prado, as joint tenants,
whose legal address is 1538 Spruce Street, of the County of Pueblo
and State of Colorado, of the second part;
WITNESSETH, That the said party of the first part, for and in
consideration of the sum of Ten Dollars, to the said party of the
first part, in hand paid by the said parties of the second part,
the receipt whereof is hereby confessed and acknowledged, has
granted, bargained, sold and conveyed, and by these presents does
grant, bargain, sell, convey and confirm, unto the said parties of
the second part, not in tenancy in common, but in joint tenancy,
the survivor of them, their heirs and assigns forever, all the
following described lot or parcel of land, situate, lying and being
in the County of Pueblo and State of Colorado, to wit:
That portion of alley to be vacated by the City of Pueblo lying and
being adjacent to Lots 1 and 2, except East 10 feet, of Lot 2,
Block 81, C.F. Ray's Subdivision of Lots 20, 21, 22 and 23 in Block
81 of Steelton Subdivision of Lots 3 and 6, Block 42, Uplands Park,
Town of Bessemer, now a part of the City of Pueblo, County of
Pueblo, Colorado.
Reserving, however, an easement for utilities as presently located
thereon.
TOGETHER with all and singular the hereditaments and
appurtenances thereunto belonging, or in anywise appertaining, and
the reversion and reversions, remainder and remainders, rents,
issues, and profits thereof, and all the estate, right, interest,
claim and demand whatsoever of the said party, of the first part,
either in law or equity, of, in and to the above bargained
premises, with the hereditaments and appurtenances.
TO HAVE AND TO HOLD the said premises above bargained and
described, with the appurtenances unto Randolph C. Prado and
Genevieve Prado, the survivor of them, the said parties of the
second part, their heirs and assigns forever. And the said Elissa
Figueroa, party of the first part, for herself, her heirs,
executors and administrators, covenant, grant, bargain and agree
to and does with the said parties, of the second part, their heirs
and assigns, the above bargained premises in the quiet and
peaceable possession of said parties of the second part, their
heirs and assigns, against all and every person or persons lawfully
claiming or to claim the whole or any part thereof, by through or
under the said party of the first part to WARRANT AND FOREVER
DEFEND.
