HomeMy WebLinkAbout06086Reception 1121842 05 /16/1996 ORDINANCE NO. 6086 AN ORDINANCE ANNEXING THE AREA COMMONLY KNOWN AND DESCRIBED AS 3820 WILLOW LANE WHEREAS, the City Planning and Zoning Commission has recommended that the area described in Section 1 hereof be annexed to the City of Pueblo; and WHEREAS, the City Council has heretofore found and deter- mined by Resolution that the Petition For Annexation and the area described in Section 1 hereof to be in compliance with the notice and other applicable provisions of the Municipal Annexa- tion Act of 1965 and C.R.S. §31 -13 -104, 105 and 107 (1); and WHEREAS, the City Council has by Resolution found and determined that an election is not required under C.R.S. §31 -12- 107(2) and no additional terms and conditions are to be imposed upon the area described in Section 1 other than those set forth in the Petition For Annexation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The following described area situated in Pueblo County, Colorado, is hereby annexed to Pueblo, a Municipal Corporation, subject to the terms and conditions set forth in the Petition For Annexation, and the official map of the City shall be amended to show such annexation: -1- Book: 2892 Page: 155 Chris C. Munoz Paqe: 2 of 7 Pueblo Co,Clk. &Rec. A parcel of land described in that deed filed for record December 6, 1966 in Book 1606 at Page 585 in the records of the Pueblo County Clerk and Recorder recited as follows: The East 2/3 of Lot 121 of Goodnight Avenue Place, Second Filing, according to the recorded plat thereof duly filed in the office of the Clerk and Recorder of said Pueblo County on the 12th day of April 1916. EXCEPTING THEREFROM: A parcel of land described in that deed filed for record October 27, 1971 in Book 1703 at Page 56 in the records of the Pueblo County Clerk and Recorder, recited as follows: The parcel of land located in East 2/3 of Lot 121 of Goodnight Avenue Place, Second Filing, according to the recorded plat thereof duly filed in the office of the Clerk and Recorder of Pueblo County on the 12th day of April 1916, said property being more specifically described as follows, to wit: Commencing at the SW corner of the above described parcel and proceeding along the south line of Lot 121, a distance of 25 feet to a point; thence North parallel to the East line of said Lot, a distance of 65 feet, to a point; thence West, parallel to the South line of said Lot, a distance of 25 feet to a point; thence South a distance of 65 feet, parallel to the East line of said Lot, to point of beginning, said parcel contains 0.61 acres more or less. SECTION 2. Within thirty (30) days after the effective date of the Ordinance the City Clerk shall: (a) File one copy of the annexation with the original of this ordinance in the office of the City Clerk; (b) File two certified copies of this Ordinance and annexing map with the Pueblo County Clerk and Recorder; -2- Book: 2892 Page: 156 Chris C. Munoz Page: 3 of 7 Pueblo Co.Clk. &Rec, (c) File one certified copy of the annexation map and this Ordinance with the Southeastern Colorado Water Conser- vancy District. SECTION 3. The City Council hereby consents to the inclusion of the annexed area in the Southeastern Colorado Water Conservancy District pursuant to C.R.S. §37 -45 -136 (3.6). SECTION 4.
