A RESOLUTION APPROVING SUPPLEMENT NO. 1 TO A LEASE AGREEMENT FOR OFFICE
SPACE BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE UNITED
STATES OF AMERICA, AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE
SAME
WHEREAS, the City of Pueblo entered into a Lease Agreement with the United States
Government on May 17, 1995; and
WHEREAS, both parties wish to amend the Lease; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
A certain Supplement No. 1 to the Lease Agreement, a copy of which is attached hereto
and made a part hereof by reference, after having been approved as to form by the City Attorney,
by and between the City of Pueblo, a Municipal Corporation, and the United States of America
relating to the rental of office space in the terminal building at the Pueblo Memorial Airport is
hereby approved, subject to the conditions as set forth in said Supplement.
SECTION 2
The President of City Council is hereby authorized to execute said Supplement No. 1 to the
Lease Agreement on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the
Seal of the City thereto and attest the same.

AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME,

Should City Council approve a supplement to the lease agreement between the City of
Pueblo and the United States of America to extend the current lease agreement for an
additional ten (10) years?
RECOMMENDATION
Approval of this Resolution.
BACKGROUND
On April 24, 1995, the City Council approved a lease agreement with the United States of
America for 1,490 square feet of office space in the terminal building for the FAA RAD-
NAV Maintenance Staff. This lease agreement expired September 30, 2002. The federal
government is requesting that this lease be extended for an additional ten (10) years to
begin on October 1, 2002 and end on September 30, 2012. The rental rate has also been
increased.
FINANCIAL IMPACT
The annual rental rate will be as follows:
1,230 sq. ft. @ $16.50 per sq. ft. annually = $20,295.00
(currently, the annual rate is $16,691.10)
260 sq. ft. @ $9.79 per sq. ft. annually = $ 2,545.40
(currently, the annual rate is $1,765.40)
10 parking spaces at $120 each annually= $ 1,200.00
(rate not changed on parking spaces)
TOTAL: $24,040.40
The current total is $19,656.50. The new rate will produce $4,383.90 more in revenue
annually for the City.

SUPPLEMENT No. 1 made and entered into by and between City of Pueblo, Pueblo
Municipal Airport, hereinafter referred to as the "Lessor," and the United States of America,
hereinafter referred to as the "Government."
WITNESSETH
WHEREAS, with Lease No. DTFA11 -95 -L- 15154, dated May 17, 1995, the Government was
authorized to occupy approximately 1,490 square feet of office space on the first floor of the
Terminal Building, Pueblo Airport, located at 31201 Bryan Circle, Pueblo, Colorado 81001,
said space is more fully described in the Lease; and
WHEREAS, the Lessor and the Government mutually agree to modify the Lease to provide
for the Lease to be extended by five years and to provide for other particulars, as set forth
hereinbelow;
NOW, THEREFORE, effective October 1, 2002, the parties do hereby supplement the two
page short form of said Lease and ATTACHMENT A attached thereto, in the following
respects and these only:
Article 2. SERVICES AND UTILITIES shall have the following sentences added ... "The
Lessor's janitors who service the subject leased space will be screened for access to the
FAA's premises within 60 days after completion of this Supplement No. 1 to Lease. Each
janitor who is assigned to service the space shall first fill out and sign the PRE - SCREENING
SECURITY INFORMATION FORM and immediately submit same back to the FAA for the
initial clearance. If approved, the janitors will then complete the following forms for the
FAA's final clearance:
(1) Form 85P — QUESTIONAIR FOR PUBLIC TRUST POSITION.
(2) Form FD 258 — "APPLICANT" Finger Print Form.
(3) DOT F 1681 Form — IDENTIFICATION CARD /CREDENTIAL APPLICATION -
PRIVACY ACT, which will include a photo taken at eye level with full face view,
trimmed to a size of 1 and '/4 inch by 1 and 5/8 inches."
Article 3. OTHER REQUIREMENTS is altered as by changing the lower three lines to read
as follows - 1,230 SF @ $16.50 P.A.S.F. $20,295.00
260 SF @ $ 9.79 P.A.S.F. $ 2,545.40
10 parking spaces at $120 each $ 1,200.00 Total $24,040.40

Article 6. Section B. TERM — is expanded by adding the following two sentences... "Its
understood between the parties that the initial term of the lease began June 5, 1995 and ended
September 30, 2002. Both Lessor and the Government agree there will be an additional ten
year term, beginning October 1, 2002 and ending September 30, 2012 "
Article 7. AMOUNT OF ANNUAL RENT shall be changed to read "$24,040.40."
Article 8. RATE PER MONTH shall be changed to read "RENT PER MONTH 52,003.37."
Article 9. MAKE CHECKS PAYABLE TO shall be changed to add the following
sentences... "its understood Automated Clearing House (ACH) payments, through electronic
funds transfer, are being paid to the Lessor's account which was provided for during the
initial term of the subject lease. Rent shall be payable to the Lessor in arrears, and will be due
on the last workday of each month, without the submission of invoices or vouchers. Subject to
available appropriations. Rent shall be considered paid on the date a check is dated or an
electronic funds transfer is made. Rent for a period of less than a month shall be prorated."
Article 10. NAME AND ADDRESS OF OWNER shall include the street address of "31201
Bryan Circle."
ATTACHMENT A RENEWAL OPTION shall be amended to provide for the date in the
second to last line to be changed from "30` day of September, 2002" to "30` day of
September, 2012."
ATTACHMENT A TERMINATION shall also apply to the extended lease period of October
1, 2002 through September 30, 2012.
ALL OTHER TERMS AND CONDITIONS of said Lease, including ATTACHMENTS A, B
and C, and including the eight page attachment labeled "GENERAL CLAUSES" are hereby
ratified and, except as amended hereinabove, shall be and remain the same.
THE GOVERNMENT AND THE LESSOR hereby agree to the provisions of this
Supplement as indicated by signatures hereinbelow of their duly authorized representatives.
