HomeMy WebLinkAbout06065Reception 1115927 04/01/1996 ORDINANCE N0. 6065 AN ORDINANCE VACATING A PORTION OF THE RIGHT OF WAY OF CHURCH PLACE (707 S. MAIN STREET) BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. All that portion of Church Place (Corona Avenue) right - of way, as platted in South Pueblo, in the former town of South Pueblo, now part of the City of Pueblo, accord- ing to the recorded plat thereof and as platted in Wayland Place, a subdivision of Lots 3, 4, 5 and 6, of Block "R" in the former town of South Pueblo, according to the recorded plat thereof, filed for record October 8, 1889, being more particularly described as follows: Considering the centerline of South Main Street (Wayland Place), as platted in said Wayland Place, to bear N.44 °45 "E, and all bearing contained herein being relative thereto. Beginning at the Southwest corner of Lot 10, Block 2 in said Wayland Place; thence along the South- westerly boundary line of said Block 2, the follow- ing two (2) courses: 1. N.78 0 48'55 "E., a distance of 71.72 feet; 2. N.71 0 34'06 "E., a distance of 61.58 feet to a line lying 5 feet Northwesterly of and equidistant to the Northwesterly right -of- way line line of South Main Street (Wayland Place) as conveyed to the City of Pueblo by deed recorded in Book 326 at Page 501 of the Pueblo County records; Thence S.44 0 45'31 "W., along said 5 foot offset line, a distance of 103.49 feet; thence N.82 0 02'40" W., a distance of 23.36 feet to the Southwest corner of an existing building; thence N.63 0 01'35" W., a distance of 38.29 feet to the Northwesterly line extended of said Lot 10; thence N.03 °49'55 "E., along said Northwesterly line extended, a distance 19.89 feet to the Point of Beginning, Book: 2878 Page: 908 Chris C. Munoz Page: 2 of ? Pueblo Co.0 k, &Rec. is hereby vacated, reserving, however, to the City of Pueblo and utility owners the right at all times to repair, operate or replace existing utilities and sewer and water lines, and mains together with the right of ingress and egress to accom- plish same. SECTION 2. The reservation set forth in Section 1 hereof shall auto- matically terminate upon recording in the Pueblo County Clerk and Recorder's office a verified statement of the Director of Public Works of the City of Pueblo certifying that all utili- ties and sewer and water lines, and mains existing in said vacated street have been removed or abandoned. SECTION 3. This ordinance shall become effective immediately upon final passage and approval.
