HomeMy WebLinkAbout06049Reception 1108880 02/02/1996 ORDINANCE NO. 6049 AN ORDINANCE ANNEXING THE AREA COMMONLY KNOWN AND DESCRIBED AS NORTH OF RED CREEK SPRINGS ROAD, SOUTH OF PLANEVIEW STREET AND WEST OF CHESTNUT DRIVE WHEREAS, the City Planning and Zoning Commission has recommended that the area described in Section 1 hereof be annexed to the City of Pueblo; and WHEREAS, the City Council has heretofore found and deter- mined by Resolution that the Petition For Annexation and the area described in Section 1 hereof to be in compliance with the notice and other applicable provisions of the Municipal Annexa- tion Act of 1965 and C.R.S. X31 -13 -104, 105 and 107 (1); and WHEREAS, the City Council has by Resolution found and determined that an election is not required under C.R.S. X31 -12- 107(2) and no additional terms and conditions are to be imposed upon the area described in Section 1 other than those set forth in the Petition For Annexation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The following described area situated in Pueblo County, Colorado, is hereby annexed to Pueblo, a Municipal Corporation, subject to the terms and conditions set forth in the Petition For Annexation, and the official map of the City shall be amended to show such annexation: Book: 2864 Page: 105 Chris C. Munoz Page: 2 of 3 Pueblo Co.C1k.&Rec. A parcel of land in the S 1/2 of the NE 1/4 and the N 1/2 of the SE 1/4 of Section 4, Township 21 South, Range 65 West of the 6th P.M., and being more particularly described as follows: Considering the West boundary line of Westwood Village, according to the recorded Plat thereof, filed for record June 6, 1961, to bear 5.02 0 52' 39" W., and all bearings contained herein being relative thereto. Beginning at the Northwest corner of Lot 1, Block 7 in said Westwood Village; thence N.87 52 along the South right -of -way line of Planeview Street, as platted in Sunny Heights, Second Filing, according to the recorded plat thereof, filed for record April 12, 1952, a distance of 1075.30 feet; thence 5.02 °52'39" W., a distance of 1624.57 feet, more or less, to the North right -of -way line of Red Creek Springs Road, as conveyed to the County of Pueblo by deed recorded in Book 39 at Page 398 of the Pueblo County Records; thence S.88 °37'21" E., along said North right -of -way line, a distance of 1075.58 feet, more or less, to the said West boundary line of Westwood Village; thence N.02 52'39 "E., along said West boundary line, a distance of 1610.38 feet to the Point of Begin- ning, containing 40 acres, more or less, SECTION 2. Within thirty (30) days after the effective date of the Ordinance the City Clerk shall: (a) File one copy of the annexation with the original of this ordinance in the office of the City Clerk; (b) File two certified copies of this Ordinance and annexing map with the Pueblo County Clerk and Recorder; (c) File one certified copy of the annexation map and this Ordinance with the Southeastern Colorado Water Conser- vancy District. The City Council hereby consents to the inclusion of the annexed area in the Southeastern Colorado Water Conservancy District pursuant to C.R.S. X37 -45 -136 (3.6). SECTION 4. This Ordinance shall become effective immediately upon final passage and the annexation shall be effective for ad valorem tax purposes on and after January 1, 1997.
