HomeMy WebLinkAbout06007Substituted Copy 9 -11 -95 ORDINANCE NO. 6007 AN ORDINANCE AMENDING CHAPTER 7 OF TITLE XVI OF THE 1971 CODE OF ORDINANCES RELATING TO THE PUEBLO PRETREATMENT PROGRAM AND PROHIBITED WASTES AND PROVIDING PENALTIES FOR VIOLATION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicates material being deleted; underscoring indicates new material being added.) Subsections (d), (i) and 0) of Section 16 -7 -13 of Chapter 7 of Title XVI of the 1971 Code of Ordinances, as amended, are hereby repealed and amended by adoption of new subsections (d), and (i) to read as follows: [(d) Acidity or alkalinity with a daily average pH of less than 6.4 or more than 9.0; or acidity or alkalinity exceeding a maximum temporary variation of pH to not less than 5.0 nor greater than 10.0. The duration of any temporary variation shall not exceed 30 minutes at any one time. If the sewer user has a pH meter, the aggregate duration of all temporary variations shall not exceed 10% of the user's daily operating hours.] [(i) 24 -hour concentrations of the following substances in excess of the amounts shown. Iron as Fe + 15 mg/l Chromium as Cr *6 5 mg/l Copper as Cu + 3 mg/l Zinc as Zn +2 2 mg/1 Nickel as Ni+ 5 mg/1 Substances with a chlorine demand greater than 20 mg/l ] [0) An instantaneous concentration of any substance described in paragraph (i) above greater than 3 times the 24 - hour concentrations shown in paragraph (i).] Parameter MffA Arsenic, (total) 1.2 Cadmium (total) 2.6 Chromium (total) 74.2 Chromium Cr + 31.5 Copper (total,) 17.7 Cyanide (total) 3.8 Lead (total) 24.7 Mercury (total) 0.013 Nickel (total) 17.1 Silver (total) 11.7 Zinc (total) 141.0 Any person who violates any provision of this Ordinance shall be subject to the enforcement actions, remedies and penalties provided for in Chapters 7, 9 and 10 of Title XVI of the 1971 Code of Ordinances, which enforcement actions, remedies and penalties are intended to be cumulative; and it is hereby declared to be unlawful for any person to violate any provision of this Ordinances and upon conviction thereof, said person shall be punished as provided in Section 1 -2 -1 of the 1971 Code of Ordinances, as amended. Section 3 . This Ordinance shall become effective thirty days after final passage and approval or upon approval by the United States Environmental Protection Agency's whichever occurs later.
