HomeMy WebLinkAbout06003ORDINANCE NO. 6003 AN ORDINANCE AMENDING CHAPTER 1 OF TITLE V OF THE 1971 CODE OF ORDINANCES BY THE ADDITION OF A NEW SECTION THERETO RELATING TO BALLOT TITLES FOR REFERRED MEASURES, INITIATIVES AND REFERENDUM AND PROTESTS CONCERNING SUCH BALLOT TITLES BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate material being deleted, underscoring indicates material being added) SECTION 1. Chapter 1 of Title V of the 1971 Code of Election is amended by the addition of a new Section 5 -1 -10, to read as follows: 5 -1 -10 Ballot Titles (1) The City Council by resolution or ordinance shall fix the ballot title for each initiative. referendum. or referred measure which shall fairly express the true meaning and intent thereof. (2) Any person presenting an initiative or referendum petition or any registered elector who is not satisfied with the ballot title fixed by the City Council and who claims that the ballot title is unfair or that it does not fairly express the true meaning and intent of the proposed measure may file a written request for review setting forth the reasons and rog, unds therefor with the City Clerk within seven calendar days after the ballot title is fixed by the City Council. The request for review shall be heard at the next regular meeting of the CUJ Council. The decision of the City Council on the request for review shall be final and binding on n the person filing- the request for review. the persons presenting the petition and the City. SECTION 2. If any provision of this Ordinance shall be held to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect any of the remaining provisions of the Ordinance. SECTION 3. All ordinances and resolutions of the City inconsistent with this Ordinance are repealed to the extent only of such inconsistency. SECTION 4.
