HomeMy WebLinkAbout05998ORDINANCE NO. r AN ORDINANCE AUTHORIZING THE CANCELLATION AND SURRENDER OF CERTIFICATES OF PURCHASE FOR DELINQUENT SPECIAL IMPROVEMENT DISTRICT AND OTHER ASSESSMENTS ON PROPERTY FOR WHICH A GENERAL TAX DEED HAS BEEN ISSUED WHEREAS, the City of Pueblo has been issued and now holds Certificates of Purchase issued by the Pueblo County Treasurer for delinquent special improvement district and other assessments, and WHEREAS, general tax deeds have been issued and, in the future, may be issued by the Pueblo County Treasurer for real property which is subject to City's Certificates of Purchase, and WHEREAS, pursuant to Colorado law a general tax deed extinguishes any lien based upon a special improvement district or other assessment created prior to the issuance of a certificate of purchase for delinquent general property taxes upon which such tax deed is based, and WHEREAS, if a general tax deed is issued, the validity of any lien based upon a special improvement district or other assessment created subsequent to the issuance of a certificate of purchase for delinquent general property tax upon which such tax deed is based is doubtful, and WHEREAS, holding and maintaining Certificates of Purchase by the City on real property for which a subsequent general tax deed has been issued creates an undue and unreasonable hardship and expense upon both the Pueblo County Treasurer and the City of Pueblo, and WHEREAS, the cancellation and surrender of Certificates of Purchase on real property for which a subsequent general tax deed has issued would be in the best interest of the City of Pueblo and its citizens; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 The Director of Finance is authorized and directed to surrender, cancel and discharge Certificates of Purchase issued to the City by the Pueblo County Treasurer for delinquent special improvement district or other assessments on real property for which a Pueblo County Treasurer's Tax Deed has been validly issued pursuant to §39 -11 -101, et. seq. C.R.S. for delinquent general property taxes, provided (a) any and all bonds for such special district improvements have been paid in full, and (b) the date of issuance of the Pueblo County Treasurer's Tax Deed is subsequent to the date of the final passage of the assessing Ordinance for such special improvement district or other assessment. SECTION 2 Any and all Ordinances of the City of Pueblo in conflict with this Ordinance are repealed to the extent of such conflict but only to the extent necessary to effectuate the provisions of this Ordinance. SECTION 3 This Ordinance shall become effective upon final passage.
