HomeMy WebLinkAbout05997ORDINANCE NO. 5997 AN ORDINANCE AUTHORIZING THE DIRECTOR OF FINANCE TO SURRENDER AND DISCHARGE TAX SALES CERTIFICATES FOR SPECIAL IMPROVEMENT DISTRICT AND OTHER ASSESSMENTS AND TO RELEASE LIENS IMPOSED UPON REAL PROPERTY UNDER THE PROVISIONS OF THE 1971 CODE OF ORDINANCES WITH RESPECT TO REAL PROPERTY OWNED BY THE CITY OF PUEBLO AND TRANSFERRED BY THE CITY OF PUEBLO PURSUANT TO THE CITY OF PUEBLO'S AFFORDABLE HOUSING PROGRAMS WHEREAS, over the period of years liens have been imposed against certain real property pursuant to the provisions of the 1971 Code of Ordinances, (the "Liens "), and WHEREAS, in addition to such liens, assessments for the special improvement district and other charges have resulted in the issuance to the City of Pueblo of Certificates of Purchase with respect to such assessments (the "Certificates of Purchase "), and WHEREAS, certain Liens and Certificates of Purchase remain outstanding against real property owned by the City which real property may by Resolution of the City Council be transferred and used in furtherance of the City's affordable housing programs including the City's Vacant Lot Recycle Program, and WHEREAS, it would be in the best interest of the City, promote the public health, safety and welfare, and encourage the appropriate use and development of real property owned by the City, against which such Liens and Certificates of Purchase are outstanding if a mechanism and procedure existed for the release, redemption and discharge of such Liens and Certificates of Purchase; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 The Director of Finance with the approval of the City Manager is authorized to (a) release and discharge liens imposed in favor of the City under the provisions of the 1971 Code of Ordinances, and (b) surrender, cancel and discharge Certificates of Purchase issued by the Pueblo County Treasurer to the City with respect to special improvement district and other assessments, outstanding against real property owned by the City and title to which has been authorized to be transferred, sold or assigned to a qualified third -party by Resolution of the City Council pursuant to or in furtherance of the City's affordable housing programs including without limitation, the City's Vacant Lot Recycle Program. SECTION 2 Any and all Ordinances of the City in conflict with this Ordinance are repealed to the extent of such conflict but only to the extent necessary to effectuate the provisions of this Ordinance.
