HomeMy WebLinkAbout05937Reception 1073036 03/06/1995 ORDINANCE NO. 5937 AN ORDINANCE ANNEXING THE AREA COMMONLY KNOWN AND DESCRIBED AS NORTH OF COLORADO STATE HIGH- WAY NO. 78 AND SOUTH OF REGENCY PARK WHEREAS, the City Planning and Zoning Commission has recommended that the area described in Section 1 hereof be annexed to the City of Pueblo; and WHEREAS, the City Council has heretofore found and deter- mined by Resolution that the Petition For Annexation and the area described in Section 1 hereof to be in compliance with the notice and other applicable provisions of the Municipal Annexa- tion Act of 1965 and C.R.S. ~31-13-104, 105 and 107 (1); and WHEREAS, the City Council has by Resolution found and determined that an election is not required under C.R.S. ~31-12-107(2) and no additional terms and conditions are to be imposed upon the area described in Section 1 other than those set forth in the Petition For Annexation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The following described area situated in Pueblo County, Colorado, is hereby annexed to Pueblo, a Municipal Corporation, subject to the terms and conditions set forth in the Petition For Annexation, and the official map of the City shall be amended to show such annexation: Reception ~: 1073036 Date: 03/06/1995 Time: 1028 Book: 2789 Page: 32 Chris C. A parcel of land situated in the N 1/2 of the SE 1/4 of Section 9, Township 21 South, Range 65 West of the 6th Principal Meridian and located within Columbia Heights, according to the recorded plat thereof, filed for record May 23, 1888 and being more particularly described as follows: Beginning at a Point on the Centerline of Ashland Avenue and the East line of New York Avenue of said Columbia Heights (Existing City Limits line); Thence Southerly along said East line of New York Avenue a distance of 411.59 feet; Thence Easterly parallel with the North line of said N 1/2 of the SE 1/4 of Section 9 a distance of 302.86 feet; Thence along a curve to the left a distance of 286.24 feet, said curve having a radius of 420.00 feet and a central angle of 39° 02' 52"; Thence Northeasterly to the South line of said Ashland Avenue, said point being 44.39 feet West of the Northeast corner of Block 14 of said Columbia Heights; Thence Easterly along the North line of said Block 14 and the North line of Block 13 of said Columbia Heights a distance of 124.91 feet; Thence Southeasterly perpendicular to the Right of Way of Colorado State Highway No. 78 a distance of 596.56 feet to the North Right of Way of said Highway; Thence Northeasterly along said North Right of Way a distance of 60.00 feet; Thence Northwesterly perpendicular to said Right of Way a distance of 1129.22 feet to the Centerline of said Ashland Avenue (Existing City Limits line): Thence Westerly along said Centerline to the Point of Beginning, containing 7.8 acres, more or less, SECTION 2. Within thirty (30) days after the effective date of the Ordinance the City Clerk shall: (a) File one copy of the annexation with the original of this ordinance in the office of the City Clerk; (b) File two certified copies of this Ordinance and annexing map with the Pueblo County Clerk and Recorder; (c) File one certified copy of the annexation map and this Ordinance with the Southeastern Colorado Water Conser- vancy District. The City Council hereby consents to the inclusion of the annexed area in the Southeastern Colorado Water Conservancy District pursuant to C.R.S. ~37-45-136 (3.6). SECTION 4. This Ordinance shall become effective immediately upon final passage and the annexation shall be effective for ad valorem tax purposes on and after January 1, 1996.
