HomeMy WebLinkAbout05916ORDINANCE NO. 5916 AN ORDINANCE AMENDING CHAPTER 8 OF TITLE IX OF THE 1971 CODE OF OkDINANCES RELATING TO TREE AND SHRUBBERY CARE BUSINESSES BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: (Brackets indicate matter being deleted; underscoring indicates new matter being added.) SECTION 1 Section 9 -8 -4 of Chapter 8 of Title IX of the 1971 Code of Ordinances, as amended, is hereby repealed and reenacted to read as follows: 9 -8 -4: INSURANCE; REQUIRED; AMOUNTS [Before any license, as provided by this article, shall be issued for engaging in business as a tree trimmer as herein defined, the applicant shall file with the License Officer, a certificate of insurance for contractor's public liability and property damage in amounts not less than that commonly known as $50,000 /$100,000 /$10,000, automotive public liability and property damage in amounts not less than that commonly known as $25,000/$50,000 /$5,000 on all automobiles used or to be used in the conduct of his business, and in addition thereto such workmen's compensation insurance as shall be required by the statutes of the State of Colorado. If any policy be cancelled, the company issuing such policy shall immediately, and not later than ten (10) days prior to cancellation, notify the License Officer and a provision to this effect shall be written into the policy of insurance.] Before the License Officer issues any license as provided in this Chapter 8, the applicant shall submit a certificate of insurance or other proof that the applicant has in effect the following minimum insurance, which shall be maintained in full force and effect throughout the term of the license: (4 Workers' Compensation Insurance, including Occupational Disease provisions covering the obligations of applicant in accordance with the provisions of the Workers' Compensation Act as amended, of the State of Colorado. (W Vehicle and Automotive LiabiliV and Property Damage Insurance covering all vehicles to be used in the business which insurance shall comply with the requirements of state law and be written with limits of liability for and injury to one person in any single occurrence of not less than $150,000 and for any injury to two or more persons in any si gle occurrence of not less than $500,000. This insurance shall include uninsured /underinsured motorist coverage and shall provide coverage with respect to all automobiles, trucks, tractors, trailers and other similar equipment used by applicant whether owned leased hired or otherwise used bX applicant. �c) General Public Liability and Proper Damage insurance issued to and covering the liability of applicant with respect to all work performed by him, to be written on a comprehensive policy form. The insurance shall be written in amounts not less than $150,000 for injury to one person in any single occurrence for both personal injury and RropeM damage_ and not less than $500,000 for injury to two or more persons for each occurrence and aggregate for personal injuf and property damage. The policy shall have all necessary endorsements to provide coverag_e., without exclusion, for all hazards associated with tree trimming. The insurance required by this section shall not thereafter be cancelled, permitted to expire or be reduced below the required coverage without 30 days advance written notice to the License Officer. In such event, applicant's license may be suspended unless applicant procures alternate insurance providing complying coverage and furnishes proof thereof to the License Officer.
