ORDINANCE NO. 6958
AN ORDINANCE VACATING A PORTION OF A PUBLIC
STREET COMMONLY KNOWN AS CHICAGO AVENUE
LOCATED NORTH OF COLORADO HIGHWAY 78 AND
SURFWOOD LANE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1 _
All of Wabash Avenue lying adjacent to Lot 11, Block 10 and lying adjacent to Lot
1, Block 11; All of Chicago Avenue lying adjacent to Lot 11, Block 11 and lying adjacent
to Lot 1, Block 12; All of Chicago Avenue lying adjacent to Lots 16 through 20, Block 7
and lying adjacent to Lots 6 through 10, Block 8, all in Shull's Subdivision according to
the recorded plat thereof, filed for record July 14, 1887 of the Pueblo County Records,
is hereby vacated.
SECTION 2.
This ordinance shall become effective upon approval of the ordinance of the plat
of Antelope Trail Subdivision.

ISSUE
Shall City Council approve the vacation of a portion of an existing roadway
easement?
RECOMMENDATION
The Planning and Zoning Commission voted 7 -0 to recommend approval.
BACKGROUND
The applicant is requesting to vacate a portion of Chicago Avenue in order to
construct 29 residential units on a private street. Additionally, this property is
located directly adjacent to the existing Board of Water Works' water tanks.

Mr. Lytle, seconded by Mr. Soldan, moved to combine the hearings on agenda items 5, 6, and 8,
as they pertain to the same property.
Street Vacation: Antelope Trail A portion of Chicago Avenue within
Shull's Subdivision N. of Colorado Highway 78 & Surfwood Lane.

Mr. Morgan stated that the SRC is recommending approval contingent upon
addressing the SRC Memorandum.
Discussion items included private streets and Jones Avenue having left slivers
outstanding south of this property. Therefore the City is participating with the
rededication of Jones Avenue. He also recommended approval subject to the
subdivision and special area plan.
Roger Fonda, Regency Ridge Development Co., appeared representing the
application, and stated that he does not have a problem with the requirements
listed. The Special Area Plan will have a private street, and he is trying to
utilize a difficult parcel. He will continue to work with staff regarding the
landscaping plan. Mr. Fonda also agreed to a cash in lieu for the park
dedication. No one else appeared.
