ORDINANCE NO. 6957
AN ORDINANCE VACATING AN EASEMENT COMMONLY KNOWN
AS HEATHERWOOD COURT SUBDIVISION LOCATED SOUTH OF
EAST 18TH STREET AND WEST OF SALEM AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
A portion of a 20 foot public utility, drainage, public roadway and sidewalk easement as
platted in Lot 2, Heatherwood Court Subdivision, being more particularly described as
follows;
Beginning at a point on the west line of said Lot 2 said point being 15.00 feet South of the
northwest corner of said Lot 2; thence N 89 58'19" E, a distance of 200.37 feet; thence S
14 0 00'00" E, a distance of 5.15 feet to a point on the south line of said 20 foot easement;
thence S 89 W along the south line of said easement, a distance of 201.62 feet to a
point on the west line of said Lot 2; thence N 00 0 01'47" W along the west line of said Lot 2,
a distance of 5.00 feet to the point of beginning,
is hereby vacated.
SECTION 2.
This ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve the vacation of a portion of an existing drainage and
public utility, roadway and sidewalk easement?
RECOMMENDATION
The Planning and Zoning Commission voted 7 -0 to recommend approval.
BACKGROUND
The applicant is requesting to vacate a 5' section of the existing 20' wide
easement in order to facilitate the continued construction of the residential units
(a foundation was inadvertently built over this section). The drainage swale will
be re- graded within the remaining 15' easement.
