HomeMy WebLinkAbout05897Reception 1073034 03/06/1995 ORDINANCE NO. 5897 AN ORDINANCE APPROVING THE PLAT OF PUEBLO CENTER SUBDIVISION FILING NO. 3 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The final plat of Pueblo Center Subdivision Filing No. 3, being a subdivision of land legally described as follows: A portion of Lots 1 through 16, Block 57, Hobson's Subdivision, of a part of the City of Pueblo, according to the recorded plat, as filed for record November 7, 1881. All of Lots 10 through 14, Block 56, and a portion of Lots 1 through 14, Block 60 and all of Lots 15 through 26, Block 60, within the Amended Plat of Hobson's Subdivision, of a part of the City of Pueblo, according to the recorded plat, as filed for record October 26, 1887. All of Lots 1 through 5, Block 1 in the former Town of Central Pueblo, now a part of the City of Pueblo, according to the recorded plat of said town, as filed for record August 13, 1883. AND the former Atchison, Topeka and Santa Fe Railroad Right -of -Way lying Northeasterly of said Block 60 and Southwesterly of said Block 56 of Said Amended Hobson's Subdivision. AND the Vacated Streets and Alleys adjacent thereto. AND being more particularly described as follows: Commencing at the Southwest corner of said Block 60 also being the most Southerly corner of Pueblo Center, Filing No. 1, as recorded in the Pueblo County records in Book 2408 at Page 525: Thence S 45° 00' 00" E, along the Northeasterly -1- Boundary of Richmond Avenue, a distance of 5.00 feet to the Point of Beginning; Thence, N 44° 58' 35" E, parallel to the Southeasterly Boundary of said Pueblo Center, Filing No. 1, a distance of 190.53 feet; Thence, along a curve to the left, a distance of 207.10 feet, said curve having a radius of 366.53 feet and a central angle of 32 22' 28 ": Thence, N 12° 36' 07" E, a distance of 90.69 feet; Thence, N 00 25' 00" W, parallel to and 0.50 feet east of the Easterly line of said Pueblo Center, Filing No. 1, a distance of 131.69 feet to a point being 30.00 feet southerly of the North line of said Block 57; Thence, N 44 34' 03" E, a distance of 28.29 feet; Thence, N 89 33' 06" E, parallel to and 10.00 feet Southerly of the North line of said Block 57, a distance of 301.24 feet; Thence, S 45° 27' 13" E, a distance of 28.29 feet to a point on the Westerly boundary of Santa Fe Avenue, said point being 30.00 feet Southerly of the Northeast corner of said Block 57: Thence, S 00° 27' 33" E, along said Westerly boundary, a distance of 120.08 feet to a point on the Monument line of Hobson Avenue: Thence, S 00° 23' 10" E, along said Westerly boundary, a distance of 30.00 feet to a point being 20.00 feet Northerly of the Northeast corner of said Block 56: Thence, S 89 34' 07" W, parallel with the Monument line of said Hobson Avenue, a distance of 136.00 feet to a point being 20.00 feet Northerly from the Northeast corner of Lot 10 of said Block 56: Thence, S 00° 25' 53" E, along the Easterly boundary of said Lot 10 extended, a distance of 166.79 feet to a point on the former Northeasterly Railroad Right -of -Way: Thence, S 52° 24' 01" E, along said Right -of -Way, a distance of 172.39 feet to the Southeast corner of Lot 15 of said Block 56: Thence, S 89° 36' 49" W, a distance of 7.67 feet: Thence, along a curve to the left, a distance of 110.66 feet, said curve having a radius of 142.00 feet and a central angle of 44 39' 06" from whence the Southerly Right -of -Way of said Railroad and the most Easterly corner of said Block 60 bears S 44° 57' 44" W, a distance of 1.57 feet: Thence, S 44 57' 44" W, along the Southeasterly line of said Block 60 and along the Southeasterly line of said Block 1 in Central Pueblo, a distance of 416.64 feet to the Monument line of Richmond Avenue: Thence, S. 44 59 W, a distance of 20.00 feet to the Northeasterly -2- Book: 2789 Page: 28 Chris C. Munoz Page: 2 of 4 Pueblo Co.Clk. &Rec. corner of Block 4 of said Central Pueblo: Thence, N 45° 00' 00" W, along the North- easterly line of said Block 4 and of Block 61 of said Hobson's Subdivision, a distance of 295.13 feet to a point being 5.00 feet Southeasterly of the most Northerly corner of said Block 61: Thence, N 44 58' 35" E, a distance of 40.00 feet to the point of beginning, containing 5.46 acres more or less. is hereby approved; all dedicated streets, utility and drainage easements, rights -of -way and land set aside for public sites, parks and open spaces shown and dedicated on said plat are hereby accepted for public use. SECTION 2. The acceptance of such dedicated streets, rights- of -way, utility and drainage easements, public sites, parks and open spaces by the City does not obligate the City to maintain or repair same until such streets, rights -of -way, utility and drainage easements, public sites, parks and open spaces have been constructed and installed in compliance and in accordance with the requirements and provisions of Chapter 4, Title XII of the 1971 Code of Ordinances, as amended and any agree- ment entered into pursuant thereto.
