HomeMy WebLinkAbout05888Reception 1053589 08/16/1994 ORDINANCE NO. 5888 AN ORDINANCE ANNEXING THE AREA COMMONLY KNOWN AND DESCRIBED AS THE WEST SIDE OF THOMAS AVENUE TO PUEBLO BOULEVARD FROM WEST 11TH STREET TO WEST 14TH STREET WHEREAS, the City Planning and Zoning Commission has recommended that the area described in Section 1 hereof be annexed to the City of Pueblo; and WHEREAS, the City Council has heretofore found and deter- mined by Resolution that the Petition For Annexation and the area described in Section 1 hereof to be in compliance with the notice and other applicable provisions of the Municipal Annexa- tion Act of 1965 and C.R.S. §31 -13 -104, 105 and 107 (1); and WHEREAS, the City Council has by Resolution found and determined that an election is not required under C.R.S. §31 -12- 107(2) and no additional terms and conditions are to be imposed upon the area described in Section 1 other than those set forth in the Petition For Annexation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The following described area situated in Pueblo County, Colorado, is hereby annexed to Pueblo, a Municipal Corporation, subject to the terms and conditions set forth in the Petition For Annexation, and the official map of the City shall be amended to show such annexation: Book: 2751 Page: 214 Chris C. All of that portion of the West Side Addition, according to the recorded plat thereof, in the North 1/2 of the Southwest 1/4 of Section 27, Township 20 South, Range 65 West, of the 6th Principal Meridian, Pueblo County, Colorado, being more particularly described as follows: Beginning at a point on the Present City Limits line, said point being the Southeast corner of Block 29, Lot 40 of said West Side Addition, thence westerly a distance of 50 feet to the Southeast corner of Lot 38, Block 29; thence along a line joining the Southeast corner and the Northwest corner of Lot 38; thence northerly to the Southeast corner of Lot 4, Block 29; thence in a line joining the Southeast corner and the Northwest corner of Lot 4; thence northerly to the Southeast corner of Lot 36, Block 20; thence in a line joining the Southeast corner and the North- west corner of Lot 36; thence northerly to the Southeast corner of Lot 6, Block 20; thence along a line joining the Southeast corner and the North- west corner of Lot 6; thence northerly to the Southeast corner of Lot 34, Block 5; thence along a line joining the Southeast corner and the North- west corner of Lot 34; thence northerly to the Southeast corner of Lot 8, Block 5; thence along a line joining the Southeast corner and the North- west corner of Lot 8, thence northerly to the north line of the said North 1/2 of the Southwest 1/4 being a point on the present City Limit Line; thence easterly following the present City Limit Line a distance of 200 feet; thence southerly to the NE corner of Lot 1, Block 5; thence following the Present City Limit Line southerly along the West line of Thomas Avenue, to the Southeast corner of of Lot 40, Block 29, to the point of beginning, containing 2.93 acres, more or less, SECTION 2. Within thirty (30) days after the effective date of the Ordinance the City Clerk shall: (a) File one copy of the annexation with the original of this ordinance in the office of the City Clerk; (b) File two certified copies of this Ordinance and annexing map with the Pueblo County Clerk and Recorder; (c) File one certified copy of the annexation map and Book: 2751 Page: 215 Chris C. Munoz Page: 3 of 3 Pueblo Co.C1k.&Rec. this Ordinance with the Southeastern Colorado Water Conser- vancy District. SECTION 3. The City Council hereby consents to the inclusion of the annexed area in the Southeastern Colorado Water Conservancy District pursuant to C.R.S. §37 -45 -136 (3.6). SECTION 4. This Ordinance shall become effective immediately upon final passage and the annexation shall be effective for ad valorem tax purposes on and after January 1, 1995. r- A 4 ' ". The territory to be annexed as described in said map and Resolution does not include land held in identical ownership comprising twenty (20) acres or more which, together with the buildings and improvements situated thereon, has an assessed value in excess of $200,000.00 for ad valorem tax purposes for the year 1995 as restricted and defined in C.R.S. §31 -12 -105.
