AN ORDINANCE DEFINING SPECIAL PURPOSE AUTHORI-
TIES AND DETERMINING THAT REVENUES AND SPENDING
OF SPECIAL PURPOSE AUTHORITIES ARE NOT PART OF
AND ARE EXCLUDED FROM THE CITY OF PUEBLO'S
REVENUE AND SPENDING WITHIN THE PURVIEW AND FOR
THE PURPOSES OF SECTION 20 OF ARTICLE X OF THE
COLORADO CONSTITUTION
WHEREAS, certain entities have been created and established
under the Charter of the City and Colorado statutes including the
Colorado Intergovernmental Relationships Act, and
WHEREAS, such entities perform certain functions and
activities pursuant to Charter, statute, or intergovernmental
agreement under the authority of a separate board or commission
and are not subject to administrative direction by the City or its
officers, departments or agencies, and
WHEREAS, such entities' are separate and distinct from the
City, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
"Special purpose authority" means any entity which is created
or established pursuant to Charter, Colorado statute, or inter-
governmental agreement between the City and any other political
subdivision, to serve a valid public purpose, which is not an
agency or department of the City, and which is not subject to
administrative direction by the City or any of its officers,
departments or agencies.
SECTION 2
The City Council of the City of Pueblo finds and determines
that special purpose authorities are separate and apart from the
City and include, but are not limited to: Pueblo Regional Building
Department; Pueblo City- County Health Department; Pueblo Area
Council of Governments; Urban Renewal Authority of Pueblo,
Colorado; and the Housing Authority of the City of Pueblo.
SECTION 3
The City Council of the City of Pueblo finds and determines
that the revenues and spending of special purpose authorities are
not part of and are excluded from the revenues and spending of the
City of Pueblo within the purview and for the purposes of Section
20 of Article X of the Colorado Constitution.
SECTION 4
This Ordinance shall become effective upon final passage nunc
pro tune as of January 1, 1993.
