HomeMy WebLinkAbout05838ORDINANCE NO. 5838 AN ORDINANCE AMENDING SECTION 54 OF CHAPTER 3 OF TITLE XI OF THE 1971 CODE OF ORDINANCES OF THE CITY OF PUEBLO RELATING TO MASSAGE PARLORS AND PROVIDING EXEMPTIONS FOR MASSAGE THERAPISTS WHEREAS, the State legislature enacted Senate Bill 90 -37 to exclude massage therapists from the licensing requirements of the Colorado Massage Parlor Code, and WHEREAS, the Colorado Massage Parlor Code is intended to be applied statewide, and WHEREAS, it would be in the best interest of the City to conform the applicability of the City's massage parlor ordinance with the provisions of the Colorado Massage Parlor Code, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Section 54 of Chapter 3 of Title XI of the 1971 Code of Ordinances which exempts certain persons from obtaining massagists licenses is hereby amended by the addition of the following new subsection: (f) A massage therapist who performs massage therapy in an office or facility which is operated for the purpose of massage therapy. "Massage therapist" means a person who has graduated from a massage therapy school accredited by the state educational board or division charged with the responsibility of approving private occupational schools, or from a school with comparable approval or accreditation from another state with transcripts indicating completion of at least five hundred hours of training in massage therapy. For the purposes of this subsection (f), a massage therapy school may include an equivalency program approved by the state educational board or division charged with the responsibility of approving private occupational schools.
