HomeMy WebLinkAbout05808 Reception 1011845 07/12/1993 ORDINANCE NO. 5808 AN ORDINANCE ANNEXING THE AREA COMMONLY KNOWN AND DESCRIBED AS SOUTH OF REGENCY PARK AT KINGS - BORO WAY WHEREAS, the City Planning and Zoning Commission has recommended that the area described in Section 1 hereof be annexed to the City of Pueblo; and WHEREAS, the City Council has heretofore found and determined by Resolution that the Petition For Annexation and the area described in Section 1 hereof to be in compliance with the notice and other applicable provisions of the Municipal Annexation Act of 1965 and C.R.S.§ 31 -13 -104, 105 and 107 (1); and WHEREAS, the City Council has by Resolution found and determined that an election is not required under C.R.S. §31 -12- 107(2) and no additional terms and conditions are to be imposed upon the area described in Section 1 other than those set forth in the Petition For Annexation: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The following described area situated in Pueblo County, Colorado, is hereby annexed to Pueblo, a Municipal Corporation, subject to the terms and conditions set forth in the Petition For Annexation, and the official map of the City shall be amended to show such annexation: -1- Book: 2667 Page: 693 Chris C. Munoz Page: 2 of 3 Pueblo Co.C1k.&Rec. A parcel of land situated in the NE 1/4 of the SW 1/4 and in the N 1/2 of the SE 1/4 of Section 9, Township 21 South, Range 65 West, of the 6th Principal Meridian, being more particularly described as follows: Beginning at the Center 1/4 corner of said Section 9; thence, Westerly along the South boundary of Regency Park, 9th Filing (Existing City Limits Line) to the East line of Chicago Avenue; thence, Southerly along said East line of Chicago Avenue to the Southwest corner of Lot 3, Block 4, Schulls Subdivision, according to the recorded plat thereof, filed for record July 14, 1887; thence, Easterly along said South boundary of Lots 3 and 13, to the East line of the SW 1/4 of said Section 9; thence, Southerly along said East line to the South right -of -way of Ashland Avenue located in Columbia Heights, according to the recorded plat thereof, filed for record May 23, 1888; thence, Easterly along said South right -of -way to the Northeast corner of Lot 7, Block 12, Columbia Heights; thence, Northerly to the Southwest corner of Regency Square Subdivision, according to the recorded plat thereof, filed for record in Book 1857 at Page 726, also being the centerline of Ashland Avenue and existing City Limits Line; thence, Northerly along the West boundary of said Regency Square Subdivision of the North line of the NE 1/4 of the SE 1/4 of said Section 9; thence, Westerly along said North line to the center 1/4 corner of said Section 9 and to the point of beginning. Total area to be annexed is 35 acres more or less. SECTION 2. Within thirty (30) days after the effective date of the Ordi- nance the City Clerk shall: (a) File one copy of the annexation with the original of this ordinance in the office of the City Clerk; (b) File two certified copies of this Ordinance and annexing map with the Pueblo County Clerk and Recorder; (c) File one certified copy of the annexation map and this Ordinance with the Southeastern Colorado Water Conservancy District. SECTION 3. The City Council hereby consents to the inclusion of the annexed area in the Southeastern Colorado Water Conservancy District pursuant to C.R.S. § 37 -45 -136 (3.6). -2- Book: 2667 Page: 694 Chris C. This Ordinance shall become effective immediately upon final passage and the annexation shall be effective for ad valorem tax purposes on and after January 1, 1994.
