HomeMy WebLinkAbout05806ORDINANCE NO. 5806 AN ORDINANCE APPROVING THE PLAT OF REGENCY PLACE SUBDIVISION, 1ST FILING BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The final plat of Regency Place Subdivision, 1st Filing, being a subdivision of land legally described as follows: A parcel of land located in the Northeast 1/4 of the Southwest 1/4 and the North 1/2 of the Southeast 1/4 of Section 9, Township 21 South, Range 65 West, of the 6th Principal Meridian, being more particularly des- cribed as follows: All of Lots 1,2, 3, 11, 12 and 13, Block 4 of Schull's Subdivision according to the record plat thereof filed for record July 14, 1887 of the Pueblo County records, Pueblo, Colorado. That portion of vacated New York Avenue lying east of Lots 11, 12 and 13 of said Block 4, and that portion of vacated Northern Avenue lying North of Lot 1 of said Block 4. That portion of land lying within Blocks 3, 4, 5, 6, 7, 8, Lots 7 through 30 of Block 2, Lots 7 through 30 of Block 9, and all alleys and streets vacated north of Ashland Avenue within Columbia Heights according to the recorded plat thereof filed for record May 23, 1888 of the Pueblo County records, Pueblo, Colorado. More particularly described by meets and bounds as follows: Beginning at the Southwest corner of Regency Park 9th Filing recorded in book 1933 at page 515 of the Pueblo County records, Pueblo, Colorado (Rebar and plastic caps LS 6123) thence S 88 1 26 1 26" E along the South boundary of said Regency Park 9th Filing a distance of 650.31 feet to the center 1/4 corner of said Section 9; Thence S 88° 23 E along the north line of the SE 1/4 of said Section 9, a distance of 1279.45 feet; Thence S 1° 36' 12'.' W a distance of 167.34 feet; Thence S 51° 19' 48" W a distance of 200.00 feet: Thence S 38 °40'12" E, a distance of 120.00 feet; Thence S 51 ° 19 1 48" W, a distance of 280.00 feet; Thence N 38 °40'12" W, a distance of 240.00 feet; Thence along a curve to the left a distance of 260.37 feet, said curve having a radius of 300.00 feet, a central angle of 49 0 43 1 36" and whose chord bears N 63 0 32' W, a distance of 252.27 feet; Thence N 88 0 23'48" W, a distance of 600.00 feet; Thence S 1 0 36 1 12" W., a distance of 65.50 feet; Thence S 89 47' 45" W along South line of Lots 3 and 13 of Block 4 of said Schull's Subdivision, a distance of 650.16 to the Southwest corner of said Lot 3; Thence N 0 1 02 1 42" W along the West line of Lots 3 and 1 of said Block 4, a distance of 365.66 feet to the north line of the SW 1/4 of said Section 9; Thence S 88 0 26 1 26" E along said North line a distance of 3.29 feet to the Point of Beginning, said parcel contains 15.10 acres, more or less, is hereby approved. All dedicated streets, utility and drainage easements, rights -of -way and land set aside for public sites, parks and open spaces shown and dedicated on said plat are hereby accepted for public use. SECTION 2. The acceptance of such dedicated streets, rights -of -way, utility and drainage easements, public sites, parks and open spaces by the City does not obligate the City to maintain or repair same until such streets, rights -of -way, utility and drainage easements, public sites, parks and open spaces have been constructed and installed in compliance and in accordance with the requirements and provisions of Chapter 4, Title XII of the 1971 Code of Ordinances, as amended, and any agreement entered into pursuant thereto. SECTION 3. This ordinance shall become effective immediately upon final passage and approval.
